I am hope so. I just got my divorce order and after 31 days they will mail the certificate. I havent received my appointment letter yet so hopefully i will have the certificate on hand by the day i have my appontment. I will update you though

Just to update this thread: just landed today! Officer did not even bother about my pending divorce.

About my friend whose application was returned she now started her divorce proceeding and will re-apply again.

wow..congrats to you!!!.. so does it mean,, the divorce petition itself is a proof that you are separated from your ex husband,.. Id like to ask further details about the statutory declaration of marriage breakdown. Did you make it your own?or your lawyer made it for you?what are the details on it?? thanks

Hello My lady and other friends here,
Your situation is so unique and helping, and matched to mine.
I would like to get some info from your experience, would be great help.

I am Indian citizen and residing in USA since 4 yrs on work visa. wife is separated since 11 months and in india.
2 kids, out of 1 is US citizen, are in india, but with my parents, so in my possession.
I want to apply for FSWP and they say I must include all family members and even for non-accompanying, I need to go for medical\background check.

1. I need to know where exactly you define that this member is non-accompanying.
2. how do I inform and convince CIC that I am not intended to sponsor my spouse in future and she is not accompanying me now, and I can't have her medical\background check.
4. If I apply for divorce on my own, sending her notice, is this enough or it has to be court decision on paper?
3. Is there any other idea to deal with my situation, like to apply as individual and sponsor kids on later stage?

Greatly Appreciate any help. will wait for the answer.

1. In the forms there is a section about your spouse information and a question of she will be accompanying you to Canada, if you answer NO there is a section for the Reason.
2. It is mandatory for all family members irregardless if they will be accompanying or not on your application to undergo the medical and background check. If your family member will not be examined paralle with your application you cannot spinsor them under Family Class in the future. You can submit a statutory declaration of your breakdown of marriage from your wife and state on the declaration that you understand that you cannot sponsor her under family class.
3. You can file your divorce by yourself if you can. It is better though to submit your FSWP with your divorce certificate so your wife will not be included in your application. Just submit a copy of your divorce certificate together with your FSWP application.
4. You can have your kids as NON ACCOMPANYING for now as long as they will undergo medical exam and background check then you can still sponsor them in the future. Just remember that there is already a change on the definition of a dependent child so check on that too.

I had a question and would appreciate if someone could answer it. I have currently applied for FSWP but have listed my wife as un-accompanying. My two daughters are accompanying me. Would there be a problem? My wife needs to stay here due to family and professional obligations. In would want to sponsor her in the future.

I dont see any problem with that set up as long as your wife undergo a medical exam and background check. All non -aacompanying family member must pass the medical exam and background check during the processing of your application so you can sponsor them in the future.

Hi I have same case with you .my Pr was just approved and planning to exit this may together with my son. I did not include my spouse as he is not visible anymore.. Is there any requirements I need to show at the time of entry from phils to vancouver?

Send your PR application, attached a letter explaining that you have already filed a divorce petition, state the date the divorce petition was filed, received and signed by your ex-wife and date that you finally files the uncontested divorce petition. If you can wait for your divorce order which will be released once you files for your uncontested divorce and used it as an attachnent instead of your divorce certificate will be better.

Hello,

i am preparing for canada immigration either EE or PNP. me and my wife have separated since last 6 months. our divorce case is going on but it may run for many year like 4 to 5 or it may reject. i have following questions...

1) shall i apply alone for canada immigration?

2) shall i have to mention my marital status married or separated?

3) if my wife will not ready for medical test and PCC than what option i have?
