So your spouse is applying and you are sponsoring? The person who is sponsoring cannot be on OW to sponsor a spouse unless on disability. You need to get off OW for some time, before sponsoring.

Yes, I am the sponsor. The visa application might take 2+ years for approval, do I need to be off OW for the whole time or after submission, can I rejoin OW again.

Also, if I remain on OW and able to prove that I can support her through family support, does it improve my chances for approval.

You need to be off OW when you apply, and not reapply until she is PR. You cannot be on OW and prove support as you are her only family member. What would be H&C grounds? You can hire a lawyer but will cost a lot of money and you are on OW. Also you don't want to apply until you have been off OW for a few months.

I'm living in Canada without any family support or a reliable support network which has made it challenging for me to secure and sustain paid employment. As a result, I'm currently on OW.

Without spousal support, I can't get off OW but while I'm on OW it becomes harder to get the support I need.

I can hire IRCC approved lawyer from India which will cost less money as compared to hiring a lawyer from Canada if it would help support my case.

Also, one more thing, while the application is in process do I need to be continuously present in Canada or can I move to India for some time?

If you are not a citizen then you are expected to stay in Canada during the process. You can visit for a couple of weeks but must return to Canada. You cannot leave for months. Your spouse cannot apply until you are off OW. Right now she doesn't qualify. You have to sign a financial undertaking and there is no minimum income requirement but social assistance is a no no. Don't know how a consultant can help you.

How would spousal support get you off of OW? You are the one who has to sign the financial undertaking.

Right now I am unable to do paid work because of all the challenges of being all alone in another country. Once I have the spousal support, I will be able to do paid work and get off OW. I can sign the undertaking because of family support.

Your arguments make no sense. Why would you need family support to maintain employment in Canada? Are you a single parent? That certainly would make things more challenging but not impossible. It doesn’t sound like you are a single parent so as a single adult what obstacles do you face maintaining employment? If anything you will face more obstacles being employed as a married adult. You say you need spousal support to get off of OW but you also indicate you plan on going back on OW if you are able to sponsor a spouse. If you are unable to live on your own in Canada and support yourself then living in Canada may not be the right fit for you. How did you secure PR and have you been on OW since arriving in Canada? IRCC wants to see that you will be able to support your family and will not go back on OW as soon as you are able to. If you have never held consistent employment in Canada that should be your focus for months before you apply for sponsorship and throughout the sponsorship process. I would not be prioritizing travel to your home country except during paid holiday time.

You don't have family support to sign undertaking. There is no such thing. It is you alone who shows that you can financially support your spouse. Spouse is not eligible to apply until you are off OW. You have to find work to get off OW.

How long have you been in Canada? Have you ever worked in Canada?
