Hello Guys. I got ITA with a draw Cuttoff of 472 as Non-accompanying spouse. Now I am ready to add my Spouse before submitting the application. Spouse had WES evaluated before i got the ITA but he only wrote IELTS after ITA. When I added my spouse to the application ( WES and IELTS), Score is now 474 which is more than the draw Cutoff. I know I can add him as non-accompanying before submitting , but my only concern is the date the IELTS was done. it was after the ITA. will this constitute misrepresentation?

Where is your spouse and why would they be considered non-accompanying when you applied. That actually could be issue. Assume you may have not gotten the ITA had they been listed as accompanying originally.

Outside Canada. Obviously you can add your spouse or anyone anytime during the application process.

Not sure what you are trying to say here. But, non-accompanying to accompany and other changes are being scrutinized here. The key here being that most list non-accompanying to game the CRS system (IRCC has issued PFLs for that recently).

he only wrote IELTS after ITA - this might be an issue as well. Please check if IELTS score obtained after ITA are acceptable

Think the bigger issue is whether IRCC takes issue with the fact the fact that you listed your spouse as non-accompanying and had not listed your spouse’s IELTS scores when you submitted your application on top of that. Had your spouse been included on your application as accompanying without their IELTS scores you likely wouldn’t have had the score to receive an ITA. Was your spouse in Canada at the time? It is hard to predict how IRCC will address issues they once ignored. Would suggest speaking to a lawyer about how to address this.
