Hi all, i need some advice please, i have a friend, she was married in the philippines, but we don't have divorce back home, they are separated for 2 yrs now, and now, she has a common law partner here in canada who wants to sponsor here so she can stay, because her visa is almost expiring. Is it possible to apply for common law sponsorship for her? Thanks for the reply!

If they have been common law for a year, then yes they can apply for sponsorship. Also, apply for an extension of the current visa. She'll have maintained status until a decision is made on the extension.

Even if she is not divorce in the philippines? Her status is working under LMIA, but i dont think it will be extended. But she just applied for OINP

As long as she's common law. If her WP is refused, apply to extend her stay as a visitor. Same applies for implied status doing that.
Again, make sure she meets the common law definition. She can also file for divorce in Canada.
