Hey there - I was wondering, if a person who is on a closed work permit that is set to expire receives sponsorship from a different employer, are they able to work for the second employer immediately under implied status or while their application is processing? I know that pending applications grant implied status to open work permit holders but I wasn't sure how it worked with closed work permits under different employers.

Let me know. Thanks!

Implied status would only allow you to continue working for yourcurrent employer but you are not trying to extend your work permit to continue working for that employer.

I'm actually trying to bring someone on as an employer through the francophone mobility program. I did some more reading on the matter and it sounds like IRCC will grant someone authorization to work while a case is pending sometimes but I'm not sure of the circumstances surrounding. They are already in Canada and it's a viable hire on our part assuming the person isn't going to be waiting 120 days for the application to clear. Do you know if that authorization is commonly granted?

Extremely dependent on the profile of the applicant and the job being offered.

Do you know any of the major factors considered? Honestly I'd have thought that pre-emptive work authorization would be pretty standardized and consistent, especially in a case where no LMIA is necessary and the applicant is already in Canada with an offer in hand.

They are on a closed work permit in Quebec and they wish to find a closed work permit elsewhere. I'm trying to sort this out. Please don't make assumptions about anyone's case or circumstance, there are a lot of potential circumstances out there.

Things like pay, job history, location, how they learned French, etc.
Ohh okay. They learned it in Quebec and have worked for the same employer in QC for like 6 years or so. I know you can't adjudicate this on your own lol but it's just a tough call. At any rate I truly appreciate your input.
