Immigration to Canada with family

I am an Indian citizen, my spouse is Pakistani, and we live in the Middle East with our baby. We are planning to move to Canada for a secure future because, due to visa restrictions and our different nationalities, we cannot realistically settle together permanently in either India or Pakistan.


We have around CAD 100,000 in savings. Our plan is for my spouse to pursue a Master's in Computer Science while I look for a job in Canada, or we may start a small business if that is a better option.


If we live in Canada for a few years, would we have any possibility of applying for permanent residence on Humanitarian & Compassionate (H&C) grounds, considering our unique family situation? Or would you recommend a different immigration pathway?

Your family is not unique and H&C is not an option nor are you eligible. You live in the Middle East, and you can settle back in either country. Plus H&C takes 10 or more years to process, and it is possible you cannot work or have access to healthcare. You immigrate live everyone else through economic pathways like Express Entry. Depending your age and your CRS score, you may never be invited. You are coming to study and may leave when completed.

Having a child can really help but it doesn't guarantee anything. And better to apply later on, not after a few years, you and your child should be well established with strong ties in Canada by the time you apply for H&C. Other conditions are also applicable.

Child is not Canadian and they don't have any ties to Canada at all. H&C is really not an option when they are not even in Canada, and even if they are they can immigrate through economic programs like EE.

Recent examples that even with a Canadian child JRs of denied H&Cs were dismissed. You need more than just a child or Canadian child for H&C approval these days. For example if a child has medical needs that can’t be treated in their home country or the home country of the parents then they would have a good chance of H&C approval. Many will also get removed before their H&C case is processed.

How old are you and your spouse? What are your work and education histories? Do either of you know French? If you are the primary breadwinner and if you have a good job in the Middle East will you be able to show that it makes sense to enrol in a masters program. Do you work for an employer that has offices in Canada? Canada does not have a lot of universities so have you explored whether you have a good chance of getting accepted into a public university masters program? Applying from a 3 rd country makes things complicated because you don’t have a lot of proof that you will return home after your studies even if your longterm goal is to live in Canada.

Stop being ridiculous. You are not even in Canada and you’re bringing up H&C grounds. Unique ? What in gods name is unique about your situation ? You’re a couple with a kid . That’s not unique

It’s getting tedious to say the least that people who aren’t even in Canada , with ZERO connections to this country are mentioning using H&C
And your child isn’t even in Canada .

It's not about a child being a Canadian. it's the best interests of the child which has the most value in any H&C, and it does help in any H&C.

I don't understand why some people are being judgmental without taking the time to read what I actually wrote in my question. An H&C application is only a last resort that I would consider if none of the other options work after spending several years in Canada. I would genuinely appreciate sincere advice on which immigration pathways or provinces I should focus on to maximize my chances of settling in Canada.

We are both 32 years old. My spouse has a Bachelor's degree in Computer Science with a 3.4 GPA and several years of professional experience in IT. We have researched our options, have sufficient funds to cover tuition and living expenses, and believe she can secure admission to a public university in Canada.

Our plan is for my spouse to study while I work on an open work permit, if eligible. However, we are uncertain about which province would offer the best balance of educational opportunities, employment prospects, and realistic pathways to permanent residence after graduation. We would sincerely appreciate advice on which provinces or immigration pathways we should focus on to maximize our chances of successfully settling in Canada.
