Not sure I would consider this reform. As you correctly point out given the backlog IRCC seems to be depending on people being removed or given up on H&C versus actually reforming a program. Denying applications and then overwhelming the courts seems to be another strategy.
Which is exactly why the program is not functional. We’ll wait and see how many hot AIP in 2026 but I think it will be much lower given how big the backlog already is.
Friends, I would need your suggestions on this scenario & not of any negative feedbacks please as I have been going through a lot lately.! I submitted H&C in Dec 2024,my spouse was working a full time job. Our permits expired on April 2026 & we applied for Open work permit & kids study permits before expiry. In June 2026, all our Work/Study applications were refused by IRCC as a result my spouse lost his job & kids stopped there school. We have applied for restoration of status as visitor & it would take 4-5 months to receive the status. My question.: can my kids continue schooling in September? I have applied for ATIP notes , just in case if eligibility is started can we have hope to get AIP before December?
Whether your kids can attend school will depend on the Province/school board. If they have already mentioned needing a study permit there is a good chance they will need a study permit to attend. If parents are not working or studying they would have to also pay international fees. The bigger issue is processing for H&C for your application date is currently over a decade. It will likely take many years to see if you can get approved for AIP. You can attempt to restore to visitor status but that is far from guaranteed since you are actually trying to live in Canada as visitors. A visitor would not attend school for example. As Canada attempts to reduce the volume of temporary residents IRCC is more reluctant to restore a whole family to visitor status or someone who has already tried to extend their work permit without an existing economic pathway to PR either in process or a concrete and realistic plan to get an ITA, AIP pr AOR for spousal sponsorship. If you do restore your visitor status and have the funds to show you can support your family as visitors without working it is very unlikely IRCC would keep extending your visitor status. Overstaying in Canada or working without status can have longterm implication for your family inside Canada but also in other countries. Does your family have an exceptional reason why they need to remain in Canada?

These aren’t actually reforms just directions of how H&.C should be evaluated with minor changes
But we were expecting to halt the program for a period of time until the backlogs get cleared and new border regulations suppose to put more efforts on H&C not sure why they didn’t.
