Hi All,

New here, and need some urgent Help. My Closed work permit has expired in January, and i applied for an extension (I am working currently in Alberta in I.T ) while entering the Alberta AAIP.
My Hope was to get invited and possibly nominated pending when the Work permit extension will be processed. I finally got INVITED by AAIP this month for Alberta's AAIP (Alberta Immigrant Nominee Program), and i have submitted my application last week, but it has not been processed.
But unfortunately, my work permit extension application was rejected today. Has anyone been through this before? And how did they solve it?

I have invested so much, as i came in through 1yr Schooling program..

What stream? You can no longer work and are out of status. So you were nominated so you received invitation and have certificate to apply for PR? Or you were just invited? Big difference between the two.

The Stream is "Accelerated Tech". I only got an invitation from Alberta, not a certificate.
Is there any hope? I want to believe that someone has experienced this before and found some success.

So you don't need a job offer for the stream. So talk to your employer and say that you can no longer work for them for some time maybe once PR depending on timelines. So you applied for a fake extension so don't think you can apply for work permit inside Canada nor maintain status.

If you are nominated under the Accelerated Tech Pathway and did not have a valid work permit at the time of nomination, you received a 204(c) Letter of Support in your nomination package. Use your 204(c) Letter of Support to apply to IRCC for a work permit.

If you were not eligible to receive a 204(c) Letter of Support at the time of nomination, you can request a 204(c) Letter of Support from AAIP if you have a valid job offer to work in Alberta. You can use the 204(c) Letter of Support to apply to IRCC for a work permit.

To request a 204(c) Letter of Support, follow the instructions for Option 4 in the 'Extending your work permit' section below. You do not have to provide a copy of your most recent immigration status document for Canada if you are not yet here.

Nominees who do not have a valid job offer to work in Alberta are not eligible for a 204(c) Letter of Support.

I was not Nominated. I was "INVITED".

Ok. So now employer knows that you can no longer work for them for some time. But they can still support your nomination with the job offer. So talk to them about the process as your file will need to be updated from working in Alberta to "have a bona fide job offer signed by you and your employer"

So the process is that you applied to be nominated (4-6 months), once nominated you will get letter of support to apply for a work permit. WP processing depends on your home country or where you plan to apply from but guess 3-6 months. Then you wait for EE ITA to apply for PR.

If you have an immigration lawyer then get one or if your employer has a legal department seek their guidance.

But bottomline is you cannot work. You applied for a fake extension (assume employer knew you did this) and now out of status. Don't think you can change status to visitor and your work permit cannot be processed inside Canada.

My main concern is this - I have been INVITED, but NOT nominated. But seeing that my application for the WP extension has been denied, Is it possible that my AAIP "invitation" which i applied for, can still go through successfully to being NOMINATED (If they review my profile and see that my WP extension has been denied). Remember, my WP expired January, and today I got the Rejection for the extension.

Forgive my numerous questions (please understand that my head is spinning). I have stopped work, but My employer is ready to help with Bonafide Job Offer, but People around me say "It is over", and that I have to leave the country immediately.

Why was extension refused and what did letter say? If you didn't have a LMIA then tou filed a fake extension and knew it was wrong, so would your employer. You most likely have to leave because you cannot restore status. You would wait outland for the processing. You don't want to overstay too long.

Your current application will have to be modified because you have no valid permit. I don't know if AIIP will continue with application or if it will be approved, but they must be notified of the change. You are lucky to have an employer willing to hold your job for over a year (or more) for PR if work permit is not approved.

I accept the blame.... But What would I have done differently after the WP expiration?
If the AAIP invitation (which i got) came through to nomination while the WP extension was still on, the story would have been different.
