So I just got my ECOPR and my spouse is abroad. We didn't apply together cuz of her work contract and it only ends by coming December and I was planning to apply for sponsorship later in June. And in Loe we said she can't come due to her work commitments, nothing else. And she is currently working in a different country. But I was not aware that this thing will take 14 months for processing, so my question is , Is it okay to apply right now for the sponsorship instead of waiting and can I say applied early because of the processing time being so long? Will IRCC ask why I didn't applied together when I did my pr (which I already said during my pr and if they want she can provide her work contract) or do you think I should wait some time before applying?

Will you still qualify if she is added as accompanying and your points are recalculated?

No it was low but at that time she didn't write any English test. If she has scored like a average clb 7 , I would have qualified. But without that at that time, no. I wouldn't qualify with her.

So that may be an issue and the risk of losing your ITA would need to be a consideration. Would suggest speaking to an immigration lawyer.

During my pr as non accompanying I wrote loe saying she can't come now due to work commitments and I would like to sponsor her later once it ends. And I think they accepted it, that's why I got my pr. But my question since she can only come by December anyway and I was planning to sponsor her later after June. I've done all my immigration files alone with the help of this forum. And lawyers cost too much even just for consultation. So do you think I should consult a lawyer in this case. If it's like necessary, I think I will.

I somewhat disagree with the concerns about this. If you have the ecopr, you should be okay. Keep your explanation about what and why your plans changed brief, and simple: you are applying now but your spouse's employment contract ends in December and she intends to move 'after that.'

Yes, there have been some cases about checking apps for those doing so immediately after - as far as I'm aware those cases have been mostly at the processing of the express entry files (eg IRCC adjusting points when processing to include spouse evaluation), and usually in cases where the spouse (who had been included as non-accompanying) was already in Canada, working in Canada, and clearly the intent had always been to have the spouse sponsored immediately. In other words, that the non-accompanying was (clearly) being done to game the points calculation.

That said, I don't follow them all, so can't say it's never happened - but for the most part good faith 'changes of plans' / reality changing are not treated as issues.

No need to wait, you can apply for the sponsorship whenever you want. No issue.
