Theres a lot of different opinions on this situation and its really hard to come up with one plan. Im just hoping that being transparent with the situation would be enough for the officers to accept whatever documentation is presented

Could you share the affidavit of separation and statuary document (after hiding personal details) with me

Are the below documents enough to prove separation or would i still need the affidavit?
  • current rental lease agreement,
  • CRA Profile screenshot showing my status as “Separated.”
  • WhatsApp Chat logs showing no contact..
  • Certified Copies of Ongoing divorce petition.

The proof of divorce petition certainly helps but always up to IRCC.
 
Hello. It is kind of similar with me. I got ITA. I put it as 'legally separated' because I have an legal separation agreement that is signed by 2 witnesses of each and 1 lawyer of each for notarization. My ex-spouse is very incooperative and irresponsive, so I was begging him almost 5 months to get it done.. Off the topic, it was so hard time to go through.. Anyway, I submitted it as an evidence because this is legally effective document. IDK what IRCC to say.. just anxious as well.. my agency said there is no need to provide any documents of ex-spouse in case of 'legally separated', but they could issue ADR for an statement that I will never support any sponsorship PR. I am just waiting their review.

Add: My agency told me the legal separation agreement is enough. I did not submit any lease agreement, bank account, bills etc., but the agreement. FYI, they have had the same case before. At that time, IRCC asked the ex-spouse's documents, but they replied the spouse is non-responsive, so impossible to obtain and will not support any PR or Visa, and then approved. Hopefully this helps.

What's your AOR date? I have the similar situation and I got ADR for divorce certificate
 
Hi @kbm91 , I yet have to submit the application. Will update you as I get any. Did you consider submitting your application as "legally seperated" since you already have filed for divorce, this is what I have been recommended with whom I did the consultation. May I ask when did you get your ITA.

AOR: Sept 11, 2025. I got an ADR for my ex's documents, not divorce certificate. I submitted a declaration saying I will not support his PR in the future and LOE written by my agency to reinforce my legal separation agreement. I can see a message in the tracker that 'We received your divorce certificate' which seems like I am okay now. I am waiting for FD.

Please keep in mind that you have to involve your ex in being cooperative to complete/sign/notarized. 2 different witnesses and 1 lawyer for you and your ex are required respectively. If you have kids, IMM5604 is also mandatory that demand your ex's cooperation too. I had so hard time to get through all this things, but anyway, it seems okay with IRCC.

I choose option 2 and waiting for an update from IRCC
 
I submitted letter of explanation few days ago only so no update from IRCC yet
Honestly, I am panicked and almost stary crying. I thought the agreement is perfect and those 3 documents I submitted are enough.... IDK what to do... maybe I should ask them to change my status to 'non-accompanying' and send another LOE like you.. what is your AOR?

September 2nd and don't panic I guess that first letter goes to everybody
