Hey Folks,

Is there anyone who's work permit got refused and sent a reconsideration request and got response from IRCC?

If so, can you please share a timeline here?

Thanks! I called IRCC yesterday to explain my situation and she told me that your reconsideration request has been forwarded to the immigration office. Do you know think they will inform me about the reconsideration update or just ignore?

It depends on a decision maker. Most often you get an update and/or a decision on your reconsideration request. Sometimes IRCC just reopens your application and makes a decision again. Not always a positive one.

Does anyone have gone through similar situation? My cousin applied for closed work permit from inside Canada in Feb 2025 within a week after Lmia approval end of January 2025 . She signed a Job offer in October 2024 and around same time employer applied for Lmia. Application was in process for almost 8.5 months. Officer has rejected the application citing reason that job offer is age (more than a year old). They didnot ask for any document or seek confirmation from employer if they have doubt that offer still valid or not. What is the fault of applicant if they are holding application for 8.5 months. She has already applied for reconsideration but her status is going to expire in 3 weeks. Any suggestion? How she can maintain status while waiting for reconsideration decision.

Read the link about extension. Her work permit applications was refused, and reconsideration doesn't allow to extend status. There are no timelines for reconsideration. If she had applied for work permit in February then she should have included an updated job offer then and not submit one from 2024. When does the LMIA expire?

I m not sure why she should have attached updated job offer? If she got lmia on the basis of that and she applied work permit within a week. If officer opened file after 8.5 months than its on him to validate if offer still valid or not. Lmia has already got expired thats why they cannot reply new work permit.

The job offer was months old when she applied for a closed work permit so easy to ask for new one. A LMIA doesn't mean the the employer is still interested in hiring the person. LMIAs take time and some employers will move on. Get a lawyer about next steps if LMIA is expired.

There are no timelines for reconsideration so once permit expires then stop working. Assume when reconsideration form was resubmitted an updated job offer was included. Also was that the only reason for refusal since you read the letter..
