Hey everyone, I currently hold a PGWP in Canada, but I had to travel to India due to an emergency. After arriving in India, I applied for a TRV, but unfortunately, my application was refused for the following reasons:
  • “In the past, you did not comply with all immigration conditions imposed in another country.”
  • “The purpose of your visit to Canada is not consistent with a temporary stay, given the details you have provided in your application.”
Has anyone faced these refusal reasons before? How can I make my case stronger and reapply to return to Canada? For context, I have never traveled to any other country, and I have always complied with all Canadian immigration conditions and laws. I genuinely have no idea what they’re referring to with these refusal notes. I’m feeling quite confused and stressed, and would really appreciate any guidance on what my next steps should be. Thanks in advance for your help!
 
When does PGWP expire? What other countries have you visited/lived in? Have you received refusals for other countries? What did you show that you will return since PGWP is temporary work permit.

Hi my PGWP expires on 16th April 2027, never visited any other country except India (my home country) and Canada nor have i applied for a visa which was refused earlier. The only interaction i had with another country was when i flagpoled US- Canada border to get my "PGWP" but faced no issues there.

I am not sure of the 3rd question " What did you show that you will return since PGWP is temporary work permit."
- If you are refering to when did i show i will return, i mentioned i will return on 16th April 2027.
 
So you declared the flagpoling on your TRV application as you would have received a refusal to enter the US. You are coming as a temporary worker so show you have ties to return that is what I meant.
 
No i did not mention flagpoling on TRV application, i didn;t know i was supposed to that. but for US i never applied for visa it was just that i wasn't admitted on the border.

In the new application should i mention i am returning to work or visiting sister where i live as well? I am speaking to multiple agents and each of them suggest different things.

Well not mentioning the flagpoling could be the reason for the first bullet. You entered the US and received an order to leave and refused entry so on file. You are on PGWP so not visiting. Reapply stating that you flagpoled and explain that you will leave when your PGWP expires. If you have property, investments in home country then include it.

My agent says it should be "Family Visit" as I live with my sister and don't need to mention work as I already have a PGWP. I spoke to immigration lawyer who mentioned it should be "Returning Worker", I am confused now what is the right option.

You are coming as a worker not a visitor. You are not coming for a family visit.
