If someone has an eight months PGWP that would be expiring before he/she would be able to get a Job Approval Letter from his/her employer, what status or immigration document should the person apply for?

And who does the application for the documents at this point, the individual or the employer?

Some persons have said to me that the person would need an LMIA, some said, a closed work permit and others an LMIA exemption letter.

Please help me, I am confused!
 
What province for JAL? Do you have ITA or nomination? You would change status to visitor and stop working.

Saskatchewan, for the JAL. And I haven't received an ITA yet.

I thought the IRCC website says that a visitor record can allow for someone who was on a PGWP to continue working?

Must I have to stop?
You stop working once PGWP expires. A JAL is just to apply for SINP and you have to be nominated first, approved for nomination to then apply for a work permit.

You mean before I can apply for a closed work permit, to remain with my employer, right?

Well for a closed work permit you need a LMIA. For JAL, you need invitation, then apply for nomination, and once you have nomination apply for work permit with JAL and work support letter. That will take a long time.

The work support letter comes once you are nominated and receive nomination certificate to apply for PR. What is your NOC and stream? Your NOC has to be selected too to get invitation. The PR process through IRCC (not SINP) is around 2 years.


If a candidate meets program requirements, their application will be approved and they will receive a Nomination Certificate. You will receive a notification that your worker has been issued a Certificate of Nomination and Work Permit Support Letter.

Just to be informed please, must I need an employer that has or is willing to get the LMIA to sponsor me through the SINP process or he/she can be without the LMIA but be willing to get the Job Approval Form from the Saskatchewan government for me?

You don't need LMIA to get PAL. But don't know what SINP stream you are eligible for but NOC should meet your education. So you don't even have an eligible employer and JAL. Not all are eligible or will get approved JAL. PNPs are small so having JAL doesn't guarantee nomination.

Did you study in Saskatchewan?
