i am creating this thread to discuss those cases of TRV who were either settled during Judicial review process by Department of Justice / IRCC or where judicial review was won in court and pending Redetermination by visa office.

Got a settlement. File reopened. Submitted additional documents. Now waiting for the decision.

it would be great if you can share some more info as it will help others.
Many face refusals and are unsure of the JR path which i believe is a path that should be pursued to get justified result for those applications which were really strong as most of these refusals are based on Chinook AI.

Yeah in case if you don’t receive settlement offer then it takes long
You mean a settlement from IRCC or court? I think the process involves bringing the case before a judge and subpoenaing IRCC takes an year then the settlement period will come.

ok Guys, finally good news on my nieces visitor visa JR. After 3 refusals and painful 6 years of waiting her visa was approved.

so for those TRV applicants, who have all of the requirements in place. i always suggest consulting a good lawyer and doing JR if applicable.
in my case, my niece had sufficient family ties, financial assets, etc. but still was getting unfairly refused so i gave it the best shot and finally succeeded.

After 2 refusals in 2019 i had thought to wait until family situations, Job, financials improve even more but even after waiting for 5 years and reapplying the application was again refused. This third application was prepared by the best law firm in Canada and we did not leave any stones unturned in preparing the strongest case.
Thus i prepared a very good base for JR as i expected the AI to auto refuse based on past refusals and exactly the same happened.

I retained Bellissimo law firm for entire journey, initial application, JR and re-determination.

i did end up spending lot of time, money and peace doing the judicial review process , but truly satisfied that my niece can finally visit along with her mother to Canada.

i hope that this gives some motivation for other forum members who are struggling with refusal of visa for their loved ones.

My advice: Do Not Give UP. Always make the initial application very strong which then provides a solid footing for future. Many of us take the initial app lightly which leads to refusals and then rejection history leading to even more refusals.
