Unfortunately received refusal for H&C application from Niagara Office on my mom's application (Submitted: Sep 2023), we are planning to order the notes to understand the grounds of refusal. She is on visitor visa rn. What are some of the other options to consider? Get Super visa, Appeal existing application or resubmit another application? Thanks (No trolls or hate comments please)

Does she still have legal status in Canada now? Has she been applying to extend her status while the H&C application has been processing?

An appeal may be worthwhile if you have a strong case and you are her only child or all of her children live in Canada.

She has been in Canada for 2.5 years continuously and previously she has been here every year for 5.5 months each year. We used the arguments of emotional, mental and financial support, community involvement etc.

yes, she has legal status in Canada and we have been applying for extensions. we are 2 siblings and both are Canadian citizens

How old is she? Can she care for herself even with some help? H&C is not a substitute for PGP and there are likely to be a lot of parents who will be denied H&C. In this case she had the ability to remain in Canada under her supervisa which I assume will be highlighted in the GCMS notes. If not on a supervisa why did you never apply for a supervisa? When does her extension end? When you receive the notes hopefully you will follow-up.

That is going to become pretty standard processing time and may actually get longer. If I am remembering correctly this may be the case where the application was something like 1000 pages which may have lead to increased processing times.

He can claim asylum while waiting for H and C, but H and C will be put on hold pending outcome of asylum. New rules did not yet take effect. It is still proposal.

If passed the implementation would be backdated to June 2025 so would automatically be denied. Having a record of having tried to claim asylum could also have significant longterm consequences in Canada and abroad.

IRCC should increase quota for H and C and refugee immediately. The current quota is unrealistic and does not make sense at all. 70K applications in the pool competing for 10k target is irrational. How to absorb people from war torn countries who are living in Canada on temporary permits, particulary families with children. These people can not be asked to leave Canada. Large part of H and C mess we are seeing now is because of overwhelming number of parent/grandparents applying for H and C.

Canada can’t just increase quotas because that will lead to increased PR numbers. If you come from a warn torn country you will likely qualify for asylum so will not be asked to leave. The H&C program needs to have much stricter requirements in terms of who can apply and we need to stop adding programs. Canada needs to prioritize economic immigration. That is just the reality. The balance can’t shift to those who typically have higher needs and lower labour market participation. The government also needs to be realistic about our ability to absorb people especially those who will place extra demands on infrastructure, may not be able to be self-sufficient, etc. This may mean shutting down refugee paths, making it harder to enter Canada, making it harder to claim asylum (already proposed), etc. until Canada has cleared some backlogs.
 
Hello all. My kids passport expires by March 2027 & ours in July 2027. Our work permits & kids study/visitor permits are expiring in April 2026. While our H&C application is in progress, is it fine to renew our passports before expiry so that we can give the permits as proof.?

Sure you can renew your passports early if your home country allows this. This doesn’t solve you issue that after April 2026 unless you have AIP you will no longer have status and may struggle to extend your status as visitors.
