Hi All!

I’m hoping to apply for a closed work permit through my current employer (registered charity), using the LMIA exemption code 51 for charity workers.
My work serves my organization‘s mandate and the organization does not benefit financially from my labor—but the parameters for qualifying are a bit vague.

Has anyone successfully applied under this exemption? And if so, would you mind sharing your job title and some of your job tasks? Or Noc code?

Since you have the LMIA exemption then you prove you can do the job/NOC with your work experience, education and language skills.

The fact that you have been employed without the exemption may make this difficult. What was your previous WP?

We don't see a lot of these here. If you want advice, I think you would really need to hire a lawyer to assist you (not a consultant).

My knowledge of this area is quite limited. However it's my understanding that the job needs to directly support the charitable organization's work and mandate. For example, this would mean you would need to be directly working with the people in the community that the charitable organization serves. An example could be someone who interacts directly and throughout the workday with underserved members of the community at a shelter or who provides counseling to women escaping abusive situations. The role has to be direct in this way. If you are in a more administrative role or a fundraising role or a social media role or something like that, then my understanding is that your role would not qualify under this exemption.
