refugee too late?

hi i am 42 years old just arrived canada from the states i was illegal and fear deportation due to trumps policy. basically i already applied for asylum 10 years ago in usa but was denied.

actually ive heard asylum process in canada is easy how ever upon my arrival i was told it takes 10 years ++ for becoming citizen as i left all my loved ones there in my birth country and wishing to returning live with them after becoming citizen and i would be 52 by then and this was a shock to me .
what are my options please

So you want to get citizenship to RETURN to the country you had an asylum claim that was denied ?

And your issue is that it’ll take too long ?

Besides your “ claim “, you’re complaining about the wait time ?

Why didn’t you self deport ?

You haven’t done your homework .
If you’ve claimed asylum in the USA , your claim here if you don’t qualify will be denied

You can’t have feared deportation that much if you’re already planning on returning to your “ country .”

I assume you have family members in Canada and this is why you are able to apply for refugee status in Canada despite the failed refugee claim in the US.

The refugee process in Canada is not easy and is quite long, as you have heard. You will not be able to return to your home country until you have citizenship without jeopardizing your status in Canada. If you are able to safely return to your home country now, then it's quite likely you do not have grounds for a refugee claim in Canada and it then would not make sense to go through the process.

If you decide make a refugee claim and it is successful, it may not take 10 years to get citizenship. However I think it would be safe to assume it will take at least 7 (of course it may take longer).

In terms of your options, if you want to go ahead and apply for refugee status in Canada, then you need to be prepared for the fact that it is a long process and you need to have a strong case to be approved. Assuming your refugee claim is successful, you also need to be prepared not to visit your home country for at least 7 years, if not longer.

If the above is not possible for you, then realistically the other option is for you to abandon your plans for the refugee claim and return to your home country now.

How long have you actually been in Canada? If over 14 days just another reason why you may not even qualify to apply for asylum in Canada if proposed legislation goes through.

hi thanks for your answer . in fact my familly is in my home country . well thats my point . my lawyer in windsor told me it takes 2 years for the hearing , add another 2 years for pr then 3 years for citizenship then 1 year for its processing time . my family is abroad and to answer your question my case is strong although i have been denied asylum in usa is simply because the us make business with my country of birth .
its really hard here in canada and even the welfare is 700$ plus life costs a lot i am currently living in my car i am really lost !

no i am alone they are in my country of origin

its really hard here in canada and even the welfare is 700$ plus life costs a lot i am currently living in my car i am really lost !

Realistically may take longer than 2 years for a hearing. The backlog is close to 300k cases with the ability to process closer to 50-70k cases a year. Asylum is really meant as an option for people when their life is in so much danger that not being able to return home is an acceptable option. You are the only one who can determine what is best for your life. If you continue with your claim you should be prepared to not be able to return to your home country for around a decade. There is the option to visit family in a 3rd country if/when your asylum claim is approved.

Unfortunately this is why it's extremely important to do research before making a big decision to try to come to another country. Processing times for asylum cases can be very easily accessed online through the IRCC web, along with detailed information about the process.

Anyway, not much you can do about that now. You will have to decide if you proceed with your asylum case or make the decision to leave Canada.

It may take more than 2 years for the pr process. I applied in May 30th, 2023 and no pr yet.

It is almost guaranteed to take over 2 years to get PR once you can apply as a protected person. If applying today there is a very good chance it will take around 3 years. There has been a huge volume of protected people and refugees added to Canada in the past 5+ years and given the goal not to increase yearly PR numbers the process will get much longer.

You are not eligible cuz you crossed from Safe Third Country (US) and you had a refused refugee claim before. Have you been referred already?

in borders i claimed refugee 2 months ago . they refered my case to a lawyer i am still waiting for my brown paper and work permit
