Hi all,

Hoping someone will be able to help me out with this. I just created my Express Entry profile. My total points are coming out to be 499 but I noticed a couple of odd things.

I am currently working in a full time, permanent position on a Post-Graduate Work Permit since August 2022. I entered all the relevant details in my application. LMIA was not included because I don't require one but on the Express Entry Profile Status, in the valid job offer section on the page, it says " Valid Job Offer: not applicable". Can anyone please guide me as to why its refusing to give me any points?

When I was looking at the criteria for the valid job offer, I meet them. I have a full time, non seasonal job for one year and more from a Canadian employer and the job is exempt from needing an LMIA. Hoping someone can help provide clarification or help me out with this. It's incredibly stressful. Thank you in advance!!!

A PGWP is not a LMIA exempt permit. You don’t get the 50 points. You need to be on a closed work permit with approved LMIA exemption.

Does your job fall under:

you have a valid work permit that is exempt from an LMIA under:
  • an international agreement
  • a federal-provincial agreement
  • the “Canadian interests” category
https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/express-entry/documents/offer-employment/lmia-exempt.html

Ah, so there's no way I can get those under the current work permit if I understand correctly?
Only if your employer gets an approved LMIA.

Can I get the LMIA 200 job offer points if the employer has submitted an LMIA exempt job offer? And I have worked with the employer for a year on an open work permit and not a closed, employer-specific work permit?

If not, can I apply for the employer specific work permit then apply for EE to get the LMIA job points? And will that 1 year work experience on open work permit count to get the lmia points or should i work for a year on that employer specific work permit?

iirc, those 200 points are for CEO and other job titles.

The job is Teer 0.

00013 – Senior managers - health, education, social and community services and membership organizations

This would be eligible for 200 points right?
Yes, this should be. The closed work permit needs to be approved before you can claim the points. Has that happened yet?

I have an open work permit. Is the "closed" work permit a requirement to claim the LMIA points?

And if I get the "closed" work permit, can I claim the points right away as I have worked for the employer for 1 year on an open work permit?

Folks, this Teer0 is a very high position that most common folks won't qualify for. The closed WP or LMIA is the least of one's problems. why I say I did immense research as I wanted to get those 200 points as I lost due to age. I am a senior director in my firm who does services in technology consulting, I got approval from the Canadian CEO and he was ready to get me a letter even from my global CEO. I even spoke with my employer's attorney a renowned immigration firm who did my WP and I often interact with WP for my subordinates.

I was told CEOs, Board members of 10 M CAD or higher, or reports to CEOs or board members in companies making 25 M or higher is what is generally the criteria IRCC expects.

The 00013 – Senior managers - health, education, social and community services, and membership organizations that jafarm denotes if you read the illustrative examples you will all realize the high standard needed to meet the burden of that  :p

I'm sure such personnel get paid a million or more every year and will have high-end immigration firms at the snap of their ginger to do their papers not soliciting fee advice in these free forums ;)

00013 - Senior managers - health, education, social and community services and membership organizations
Senior managers in health, education, social and community services and membership organizations plan, organize, direct, control and evaluate, through middle managers, membership and other organizations or institutions that deliver health, education, social or community services. They formulate policies which establish the direction to be taken by these organizations, either alone or in conjunction with a board of directors. They are employed in health care organizations, educational services, social and community services and membership organizations or they may own and operate their own business.

  • Illustrative example(s)
    • arts and culture association chairperson
    • automobile association executive director
    • business association president
    • educational institution chief financial officer (CFO)
    • health services institution executive director
    • labour organization president
    • membership organization general manager
    • music guild president
    • professional association executive director
    • scientific association chairperson
    • social services institution corporate controller
    • voluntary organization executive director

Mate, you seem to take this quite lightly.

I humbly request you to please research thoroughly, if you read the examples, roles, and responsibilities you will know if one belongs there. The burden is to meet 70% of the responsibilities. Even if I consider only pay as you say For folks playing such roles with such responsibility and titles, the lowest pay will be north of 500k Canadian. Do you make that?

If the bar was low, the lambda types working as managers in Timmies and McDonald's would have exploited the loopholes long long ago right?
