My husbands application was returned today - we got the usual letter for not including his daughters IM008/5406/PCC checks and identify docs.

The problem is she is 22 and was 22 at the time we submitted the application, she is not disabled and is a dual US/British Citizen living in New York. I panicked and checked the docs in case I entered her DOB M/D/Y or D/M/Y as her bday is Jan 12 2001 - meaning if they looked at it the canadian way of M/D/Y this would still make her 21 - but on IMM5406 her DOB is listed correctly as 2001/01/12 YYYY/MM/DD

She wasn't included as a dependent in the application, she was only listed on 5406 - I could understand if she was included as a dependent - that would align with the reason for rejection - we included her, but didnt supply any docs for her - but that's not the case at all, she is just listed in additional family information as instructed for non dependents.

I am at a loss here - we have followed the guide and done everythnig correctly yet the app was still returned. I want to cry as I feel the last 6 weeks were a waste.

I have just done the IRCC checklist for dependent children - and lo and behold its come back that she ISNT A DEPENDENT.
This is really frustrating - like someone just read the dates wrong and clicked return.

In the letter I have a UCI number - which I assume is mine as letter was addressed to me as a sponsor.

I have resubmitted with a copy of the return letter from Sydney and a LOE and a copy of her passport.
I guess just wait and see again. I suppose if it's returned again and we apply in February she will clearly be 23.
 
I did ring through to IRCC - to clarify what we were doing was correct. We went through the guidance for dependent children together and he came back and said no - she should've been only considered under the additional family as she is a non dependent.
Advised that best course of action was what I did - resubmit and provide LOE (although its tongue in cheek to write a letter or explanation when the explanation is just confirming someones age) just stated her DOB, how old she is, that she doesn't qualify and included a copy of her passport proving DOB along with the letter IRCC sent returning the original application and a screenshot of the IRCC tool results on dependent children results (ie isn't a dependent)
such a shame we go to the back of the queue now.
But hey ho - we going in May regardless just wanted that AOR more than anything as the security blanket for the OWP once we land.

Sounds like you've done everything you could.

Truth is, sometimes they **** up at this stage and send things back incorrectly.

Yep, I get that. I manage large team of admin and to think IRCC isn’t capable of human error would be very naive of me!

nowhere in the letter does it state we are being refunded fees, so when I resubmitted the application I just used the original payment reciept
Should I have paid the fees again? Will IRCC automatically refund our original payment if the application was returned?
