Yes, you can do that. No issues.
Thank you for your response, I appreciate it. Would you mind sharing the process in brief if you have some time? I tried looking for it on the US Consulate's website but could not find it in the visa category. Should I start the process by filling the DS-160 form and then I will be able to choose the visa category?

https://ais.usvisa-info.com/en-ca/niv : This is the site where you would create an account , Pay the fees and wait for the options either to "Send documents" or you would be asked to attend an interview. Accordingly you can proceed.

ps: You need not apply for H4 from outside the country, you had to only go for either dropbox or interview. Once you are inside the country then you apply for H4 for extension. First time its always different.

Hello- I’m looking to get my h4 visa stamped at Vancouver for the first time. I am a Canadian pr and live in the US. I think I am eligible for drop box. Can you share how you went about the application process ? My major question is can I travel back to the US on AVR in case they ask me to come back for an in person interview as there are no dates available for in person ?

You have to fill up the questionnaire to know if you are eligible for Dropbox or not. Yes, you should be able to use AVR . I have seen cases where people were sent back passports if in case if they are called for an interview.

Also if I’m eligible for Dropbox , do I have to ship documents from the US to the consulate and if I’m called for an in person interview , will they send the passport back? I am not aware how Dropbox appointments work in a third country and if I should travel to Canada if I’m eligible for drop box

Thanks so much for your response.By questionnaire do you mean DS-160 ?
Questionnaire on the Visa booking portal https://ais.usvisa-info.com/en-ca/niv .

Its better you are inside the country for dropbox. I dont think they can ship back the passport outside Canada.

Got it! My major concern is not being able to come back into the US in the event of refusal or an In person interview requirement. And if AvR allows us back into the US with an existing stamping appointment
There is a hiccup here. You need to be ready with all your documentation while you enter and post it the same day if possible or post it on the next day so that you will have enough time(30days AVR rule) to get your passport back in case of interview request. Better to enter on sunday night or monday morning and post it so that your application will have some enough traction during weekdays.

Is your plan to move back to US ? If yes then fine. If not you would be questioned on why would you need a H4 first of all while already having B1/B2. If not at the embassy, at the border you would be asked if you are going to travel frequently. Please keep this in mind.
Hi, I've been desperately searching for discussions related to this kind of situation since I am in a similar position. My wife is currently in the U.S. on an H1B visa, while I am here in Toronto, Canada, on a Post-Graduation Work Permit (PGWP) and I recently got my B2 US tourist visa last October (I filed it last year September 2022). We've been contemplating our options, and we've decided not to pursue permanent residency (PR) in Canada any longer. Instead, we're looking into applying for an H4 visa in the U.S. to facilitate my move there. As part of our plan, my wife's employer is currently in the process of sponsoring her for a Green Card (GC). During this period, I'm making the most of my time in Canada by working under my PGWP.

I've come across an article that mentions, "If you are outside the U.S., you will need to submit your application for an H4 Visa at the U.S. Embassy where your spouse or parent has applied or in your home country if you and your spouse are of different nationalities."

Given this information, I'm uncertain whether I can apply for the H4 visa here in Toronto or if I'll need to return to my home country.
I'm truly in a tight spot and seeking clarity on the best way to navigate this situation. If you have any advice, insights, or guidance to offer, I would really appreciate it.

Are you planning to move permanently back to USA?? If yes then better apply for H4. If not better to travel on B1/B2. Not necessarily you have to travel to your home country for H4 visa. You can apply it from Canada as well.

Thank you for your answer. That's reassuring to know that I can apply for H4 in Canada. And yes, I am planning to settle in USA for good. I am just worried about the interview because my PGWP expires on June 2024 while my wife's H1B expires on May 2024. However, her employer will apply for an H1B extension for her while the GC is still on going. Once I apply for an H4, do you think the U.S. authorities will grant me an H4 visa validity that aligns with the expiry date of my wife's H1B visa extension(probably another 3 yrs)? or will it be her original one which is next May 2024?

Its always based on your wife’s H1b validity. Its better you apply now for H4 and get inside first and then while her employer applies for H1b extension then also include your H4 petition with that for extension of H4 as well.
