Hello all, need some advise pls
We are currently in the UK on a study VISA and want to immigrate to Canada on a visitor VISA. Wife is pregnant and we planning on coming to have the baby in Canada and immigrate to Canada in the process after the birth of the child.
What are the options we have? We are thinking of applying for Assylum OR wife applying for study permit for PSW program in Canada.
- what are the chances of getting a study permit?
- what are the chances of a successful asylum application
- or can I apply for a WP considering I have masters in IT from UK university

any advise would really help

1. What is your nationality? Applying for Asylum depends upon if you are being threatened in your home country and host of other conditions.

2. Your kid getting a canadian citizenship by birth does not give you any benefit in immigration. None what so ever.

3. If you have masters in IT from UK, why don't you apply for Express Entry? Whats your age and professional experience? That MAY even open a path for an open work permit (not 100% sure, but might). Try using "come to canada" tool to calculate your points and see if you can apply for EE.

4. To apply for a WP, you need a job offer and LMIA (most likely). You might do your job search while on a visitor visa.

5. For a Study permit, your wife needs to be accepted in a post secondary program like a degree or diploma. Whats her education background?

My Nationality is Nigeria, I’m 40 yrs and I know my points in the EE would be affected by age, my wife is 30yrs and has health background currently works as healthcare worker in UK.
are there any advantages applying to these schemes while on my visit for e.g applying for a WP, would it be better if I was already in Canada and engaging Job agencies?

Cool beans! I am also 40 yr old, originally from India. And congrats for the kid in advance. 30 is a good age for having a kid, biology starts working against the ladies after 30 as far as kids go. My wife had my son at 28-29 and it was troublesome to say the least. Now, immigration:

1. Does she have a degree in health care? Nursing etc? That might be helpful in your case, check the professions for Health care draw :

Check if she fulfills the needed criteria for the occupation. That way she can have points due to age and you can help her get more points due to your degree. Try both combination and see which one gives you more points. Healthcare workers and IT folks both are desired categories for canadian immigration.

2. There are advantages and disadvantages to apply for WP / SP from in canada. Advantage is usually, in-canada applications have more linient processing. Disadvantage is you may or may not be eligible to apply from within Canada. This is because typically you need a SP or WP or your spouse need to have SP or WP for you to apply for one. But there are recent public policies which have allowed visitors to apply for SP or WP. Its a bit involved to check it thoroughly on current temporary public policies. Secondly, applying from within Canada mean you will be in Canada and not working. Which is a major drain on money. With a new kid, it will be a major drain on money, if that is a constrain for you. If you have a lot of money, then its okay. My kid needed a lot of things very quickly: stroller(almost 1000 dollars), car seat and what not.

WP from outside is HARD. I did it but then I was an internal transfer.

3. Asylum I am not sure. People from warzones typically get it but Nigeria is among one of the better countries in Africa with its oil wealth. Do you have some specific situation? Its okay if you do not feel comfortable to go in details. Its a public forum after all. In that case approach a lawyer. Refugee claims are more complex than economic immigration.

Do you currently have a visa to Canada? Current processing times for a TRV are 355 days. As far as an asylum claim, your wife is employed in what is considered a safe country. Your going to face a bit of a hurdle explaining why you didn't claim asylum in the UK, given you were already established there.

Yes we currently hold a Canadian visitor VISA, as with the safe country, I understand there’s exemptions when you have family in Canada ?
