Hello,

I have the following situation and need some guidance, please.

My sister applied for our parents for sponsorship and we are now in the process (submitted the application herself and her husband as household). A year ago, her husband got a Job in the States and he has been working from there (he is not a resident of Canada 2022-2023). I think he also filed his taxes for 2022 that he is not a resident of Canada. She is not planning to move out of Canada (or her kids too). IRCC requested documents of her husband getting in/out of Canada for the last 2 years. My questions are:
1- Can I remove him from the application and request adding myself instead? (I am a Canadian Citizen as well living here for the last 10ish years).
2- Providing the documentation that he has been living outside of Canada for the last year with more than 6 months would mean that the application will get rejection?

1. No. Only your sister's husband can co-sign the application. You cannot.
2. If he said he's a non-resident, then yes. His income cannot be included in the LICO calculation which means your sister won't meet the requirements as a sponsor and you should be expeting a refusal. You should confirm exactly what he's done for his Canadian taxes for 2022 (i.e. if he declared himself as a non-resident for 2022).

Does your sister work and make enough income on her own to cover LICO for her whole family (including her husband) + her parents?

she does for the most recent years. i think the issue would be in the first year (2019)

That's good news. Then it's possible the application could be OK. It's hard to guess without knowing all of the details and dates.

The most your sister can do is respond to the information request accurately regarding her husband's absences from Canada. If she has been making enough income the last few years to cover LICO, I would include that in the response. If 2019 was the only year she did not make enough income but her husband was in Canada and file taxes as a resident for that year, I would include that information as well.

Unfortunately you cannot be added to the application as a sponsor or co-sponsor. That is simply impossible.

You may want to double check about him filing tax as non-resident. With strong tie (his family is in Canada), he may still have to file income tax in Canada.

in my case we applied in 2021 for the interest to apply for the sponsorship and we were randomly selected in September 2022 (almost 18 months later)

There is nothing you can start now. The program is closed and hasn't reopened for this year yet.
