Hi. I'm a recent PR holder in Canada (this year). I'm planning to get married soon, and I would like to sponsor both my brother and my wife. If I sponsor my brother under the family sponsorship category, can i sponsor my future wife WHILE his application is in progress (and also after) ?

- I don't have any relative in Canada who is PR or citizen
- Both of our parents are deceased
- My brother is 30 years old

Give that info, according to the link below, I can sponsor ONE relative who is older than 18. My question is, if I sponsor my brother first, will it be a problem sponsoring my wife later?

You can sponsor one relative as long as you remain unmarried.

No, you cannot sponsor your future wife WHILE your brother's application is in progress. You cannot even get married while his application is in progress. You can only get married after his application has been finalized and he is a PR. So you would need to be prepared to hold off on your marriage for a while (i.e. likely a couple of years).

Hey, thanks for the response. That was my gut feeling, do you have a link to that clause? I couldn't find anything on Canada.ca regarding restrictions during application processing.

Also, how long on average do you think both sponorship types take (1) if I sponsor my brother first (2) if I sponsor only my wife

I don't have any link that has this specific scenario. However you have to remain eligible as a sponsor until an application is finalized / approved. If you get married, you're no longer eligible to sponsor him. So the marriage would have to wait until after he becomes a PR.

How long processing time takes for sibiling applications varies from country to country, however expect around 2 years (could be shorter or could be longer). Spousal sponsorship from ouside of Canada is estimated at 16 months right now.

One other thing. Note that you have to meet minimum income requirements to sponsor your brother and his family as well. This income needs to be from Canadian sources so that may impact timing depending on whether you just arrived in Canada or have been here a while living and working.

I have been working here for a year now (and studied for a year), and income is good enough for more than 2.

Regarding the issue of applying for the future while WHILE brother's application is in progress, I would assume it should mention in cic something general like "you have to continue to be eligible sponsor during application processing" but i can't find anything related to that under this sponsor eligibility page: https://www.canada.ca/en/immigratio...ship/spouse-partner-children/eligibility.html

Did you come across that restriction as part of user posts in this forum or did you draw that based on other applications you have seen? Thanks in advance.

To sponsor your brother, you need to meet the requirement of "lonely Canadian". Until the process is completed, IRCC can still check (and re-check) your eligibility.

Once you are married (doesn't matter if you start the application to sponsor your wife), you are NOT a "lonely Canadian. And cannot sponsor your brother as an "other relative". You are holding off marriage to "play as a lonley Canadian" and it's already "gaming" the system.

I don't have any "real example" of someone being refused because they got married while sponsoring as a lonley Canadian. But this is not a very common sponsorship route. If you want to get married, then do not try to sponsor your brother. (again, it doesn't matter if you choose to sponsor your wife or not. And if you have any children, then again, you don't qualify as well. )

I'm assuming this wording is somewhere in the manual. It's really standard across all immigration programs that sponsor eligibility requirements need to continue to be met until the application is approved, not just at the start of the application.

You can always get a consult with a good immigration lawyer on this if you want a legal opinion. Stay away from immigration consultants. This is too complex a question for a consultant.
