Hi all. I have already consulted a lawyer about this, but wondering if anyone can shed any insight into a situation, simply just because I'm currently incredibly stressed and could use some reassurance.
My boyfriend (Canadian) and myself (Australian on a WHV) entered a common law relationship (sharing a lease etc) November of last year (2022). Our goal was then for him to sponsor me for PR (Inland) once we hit the one year mark. We share a lease, utilities, bank account, all of the normal application things.
However, he recently accepted a new job on the pipeline that will have him working 3 week on 1 week off stints, 5 hours away from our house (but still within the same Province). His residence for tax purposes will still be our apartment, but he will be living at camp for those 3 week stints. At first I didn't think anything of it, and then was filled with dread when I realized that likely makes our application very complicated if not completely ineligible.
Can anybody shed ANY insight on this, perhaps a similar situation that you may have been in, or any details you might have surrounding this? I know the CIC website says this: While cohabitation means living together continuously, from time to time, one or the other partner may have left the home for work or business travel, family obligations, and so on. The separation must be temporary and short. All I have been able to gather so far is that it is fully up to the discretion of the officer and that we may no longer meet the cohabitation eligibility.
I have struggled for a number of years (2 back-to-back WHV permits) to be eligible for PR via Express Entry or PNP from work standpoints, so am feeling immensely defeated that even now via this route I am facing a risk of losing a chance yet again.
