@ melai passport copy lang hahanapin tpos mghihintay ka kc hahanapin pa nila.. January 29, 2013 nila narecieved ang application ko. puntahan nio na lng mismo sa CEM kc hndi tlga sila ngrereply ng mga emails. mga 10 am aq nkadating dun pero pinabalik aq ng 2:30pm.

Yesterday, April 29th 2013, the Government of Canada announced major changes to its sprawling Temporary Foreign Worker (TFW) program.

It has been known for several months that some program reforms have been in the works. However, the government was spurred to take swift action by a national debate on foreign workers in Canada. The debate was largely prompted by a series of high-profile alleged abuses of the program.

The TFW Program

Temporary foreign workers make up a significant portion of the Canadian workforce. In 2012 alone, over 213,000 new workers entered Canada through the TFW program. This is more than three times the amount of temporary workers admitted to Canada a decade ago.

In order for an employer to hire a foreign worker, they must generally first receive a positive Labour Market Opinion (LMO). A positive LMO states that hiring a foreign worker will have a positive or neutral effect on the Canadian labour market. In order to receive a positive LMO, an employer must successfully demonstrate that they have been unable to adequately fill the position with a Canadian citizen or permanent resident.

To prove their need for a foreign worker, an employer is generally asked to provide evidence of recruitment efforts in Canada. They must also agree to meet federal and provincial labour standards. Recently, TFW rules were amended to allow employers to pay their foreign workers up to 15% below the prevailing wage for a given position, as long as their Canadian employees were working at the same wage. A fast-track program called the Accelerated Labour Market Opinion (ALMO) was also implemented to issue LMOs to qualifying employers within 10 business days.

Changes to the TFW Program

Canadian Immigration Minister Jason Kenney and Human Resources Minister Diane Finley jointly announced yesterday’s changes. They are as follows:

Effective immediately, employers must pay temporary foreign workers at the prevailing wage by removing the existing wage flexibility;
Effective immediately, temporarily suspend the ALMO process;
Increase the government’s authority to suspend and revoke work permits and LMOs if the program is being misused;
Add questions to employer LMO application forms to ensure that the TFWP is not used to facilitate the outsourcing of Canadian jobs;
Ensure that employers who rely on temporary foreign workers have a firm plan in place to transition to a Canadian workforce over time through the LMO process;
Introduce fees for employers for the processing of LMOs and increase the fees for work permits so that the taxpayers are no longer subsidizing the costs; and
Identify English and French as the only languages that can be used as a job requirement.
The Seasonal Agriculture Worker Program, as well as other agricultural occupations, will be exempt from all but the third reform.

Motivation for the Changes

These changes have been announced amidst a national controversy regarding the role of the TFW program in Canada’s economy. Two recent incidents have brought this issue to the forefront.

Most recently, the Royal Bank of Canada, a major Canadian financial institution, was found to have replaced Canadian workers with labour from abroad. The foreign workers were brought to Canada, resulting in the laying off of 45 Canadians. Replacing Canadian labour with foreign labour is explicitly forbidden, leaving many to speculate that the company was using loopholes to manipulate the program.

Another controversy from earlier this year involved a Canadian mining company ostensibly passing over qualified local workers to instead hire 200 miners from China. One of the job requirements was knowledge of Chinese, which was widely criticized as a ploy to deliberately exclude otherwise qualified Canadian miners in favour of cheaper labour.

Minister Finley reinforced the need for program reform, saying:

“The purpose of the TFW program is to help fill genuine and acute labour needs and we have been reviewing the program to ensure that goal is met and Canadian workers are never displaced.”

Many of the aforementioned reforms speak directly to these concerns.

At the end of the day, while the TFW program is slowly being reformed, it remains an integral part of Canada’s economic and immigration policy.

Hi..im paul from qatar and ive sent my application last march 3 2013,,,,via aramex courier....and until now i didnt receive some updates regarding my application,,,do u think guys it takes how many months to receive some updates after ive sent my papers to the embasy in abhu dha bi....tnx

@ paulivan,...bro,call aramex first...if aramex tells that it is succesfully delivered,then,your application is on process...most of the applicants did not receive any AOR (acknowledgement of receipt) from CEM-Abu Dhabi. According to their processing time,it's within 1-7 months of processing,until then,we may follow-up,not unless you have an urgent situation that requires immediate attention...anyways,bro,it's not only you,...applicants from october,november,december,January(my timeline) and february are also awaiting any feedback from CEM-Abu Dhabi,...as of the meantime,let's support one another through prayers and communication...i hope our visas will be approved...i pray,i wish and i hope...God bless us,bro!....additional,bro,i am getting crazy,nervous,scared and i don't know (haha!)..Just to UPLIFT our spirits...it is really hard awaiting the result but as they always say, " patience is a virtue "...

Yup...ive called them already and it was delelivered last march 3 2013 and they asked my returned airway bill to checked and they said it still on process...by the way tnx for the info.

Did u sent your original passport? Applicants from november till this month did not receive any feedback from embassy... Im living in Qatar also and we have same situation.

I gave in a copy of all pages on my passport but not the original. By the way, I am applying for a WP without an LMO as I am applying under intra-company transfer. Any idea if this makes the process any more or any less complicated?

Guys..... We are very much affected by this, November applicants onwards are hanging by a thread here and we don't know what will be the effect on the processing times and granting of visas in the Embassy..... Will they be stricter in granting the visa now, if they are still granting it??? Are our applications on hold now because of this issue??? Sad...... :( :( :(

Guys, i supposed we are affected with this current issue which the Canadian Government is experiencing right now.Personally im a little bit disappointed of this issue since we are almost there but unfortunately this problem arise. However, im still lucky that i still have my job right
now otherwise ill be going crazy thinking over when they will grant our visa.But lets keep on praying and hoping that sooner or later they give
chance to those who already applied previously if that allegation will be implemented.
I would suggest that we still continue to share our experiences as far as our visa application is concern. Remember God works on mysterious ways
so lets lift up to him all our hopes and worries and just enjoy what you are doing. Good things happen when least expected..

Pending parliamentary approval, increase the Government's authority to suspend and revoke work permits and labour market opinions (LMOs) if the program is being misused.

The Government is seeking to amend the Immigration and Refugee Protection Act (IRPA) to provide authorities to suspend and revoke LMOs and work permits.
This would allow Human Resources and Skills Development Canada (HRSDC) and Citizenship and Immigration Canada (CIC) to suspend, revoke or refuse to process a request for an LMO. This could occur if, for example, new information becomes available indicating that the entry of a temporary foreign worker would have a negative impact on the labour market or if it is determined that the LMO or work permit was fraudulently obtained.

Suspending an LMO would stop the issuance of work permits. In cases where an LMO is suspended or revoked, CIC will review the work permits that were issued under that LMO on a case-by-case basis to determine whether the work permits should also be revoked. The parameters of this new authority will be made public once they have been determined.
