Hi, I'm in a gay relation with Thai man and we want to get married, but CIC won't let him visit to get married in canada and Thailand doesn't allow gay marriage.

We thought that South Africa might be a decent place to get married because he won't have trouble getting in, but will Canada recognize a marriage union in South Africa when I sponsor him for permanent residence?

I would advise against Moscow.

I believe they will. I found this site helpful: http://settlement.org/ontario/daily-life/life-events/marriage/will-the-canadian-government-recognize-my-foreign-marriage/

If the marriage is legal both where it took place, and in Canada, it is valid for CIC's purposes.

So for example, if a 20 year old and a 13 year old got legally married in another country, CIC would not recognise it, because that marriage couldn't happen in Canada. If a man legally married 3 women, he could only bring one of them to Canada, because Canada doesn't recognise polygamy. More commonly, if a country allows marriage with representatives standing in for the couple, Canada doesn't recognise that, because Canadian marriages require both people to be physically present. Because Canada recognises same sex marriage, a legal same sex marriage (assuming a single partner, and legal age) from anywhere will be valid in Canada. So Spain, Norway, South Africa, Mexico City - anywhere you can go to get married.

Thank you all for your answers, does anyone think I should consult an immigration lawyer for this?

Only if you are not comfortable with processing. It would be easier and hassle free for you. Note of the expense though. Personally I would advise against it, if you can prove the relationship is true and there would be no doubt for cic everything should run smooth.

Hi, marriage in South Africa is recognized in Canada.

I married my Canadian husband in South Africa.

Just check on the department of home affairs website with regards to any paperwork you might need to bring as foreigners marrying here.

All the best :)
