Yes, you can initiate divorce proceedings and file your application. Unless, the divorce is confirmed you will have to provide the medical and travel documents of your spouse.
The application has been submitted before he was told. He refused to sign the post hiv counselling form hence his medicals has not been uploaded by the panel physician. I just want to know if I can use the CSE to ask for his removal and also attach a copy of the divorce petition while waiting for the final divorce
Provide evidence that you have been separated for over a year. Add to that proof of you starting divorce procedures, along with your letter of explanation asking to remove him from your application. Nothing more you can do at this point. So do not stress out, just submit them and hopefully things will be ok.
Thanks for the advice. We have been separated since August. We travelled together to the US together and he refused to return till now. Will that suffice as enough evidence or should I just withdraw the application.
