My question is this that WWICS, YAxis & oasis these three consulatnt told me the 38 list is going to revise on 31st jan 2010 .So what will happen in my case if i file my case now in december & i get my file number after when the 38 list revised because i heard from the forum that file number will take 40-45 days . Can you answer my question that when they consider my case that it has applied from the date when i filed my paper in embassy or when i will get my file number because if they consider my case when the file number issued & i if i get my file number after 38 list revised then again i will be failed because no body knows that accountant occupation will fall in new list or not

i doubt your consultants know whether the list is going to change or not.


Even if it changes, they would consider you probably on the date they receive it in Sydney. Remember, they can set any rules they want.

Ajeet,

There's something called 'application locked'. As Rupesh said, it means the day ur apps r recd in CIO, ur apps are accepted as per the existing immigration guidelines of that day.

Thus, even if there's a change in the NOC list (whether or not, is disputable), after u submit (say Dec 2009), it's NOT going to effect ur case filing.

qorax and rupeshhari both are right, I also read an article in newspaper they are decreasing it to 10 some recommendation going on but the plans are not for Jan, 2010 they are still studying the impact and doing a study can take long time. Main pressure is coming from Ontario and BC which are pushing government to abolish some skilled worker occupation and add some unskilled e.g. truck drivers and minister of immigration for Ontario continuesly speak about this that a lot of higher skilled people get immigration then don't get successful to get jobs in their profession and end up doing low pay jobs, but other developing provinces e.g Newfoundland and Labrador, NB are against these moves and want to keep the list on. Their studies showed that the skilled immigration is better for them. So, it's an ongoing issue no final decision yet and I don't the that the change will be take place in Jan or Feb next year as the proposed study is on early stage and a draft can be found at Ministry of Human resource and skills development canada. So, be patient and see what should be the outcome.
