RO calculation process

Hi Leon,

First time landed in Canada in 1st January, 2010 and stayed 3 days went back to home country. Moved back to Canada in 4th Dec, 2011 but unfortunately I have been and forth to my country since my spousal sponsorship took a long time because of unnecessary reasons from CIC office. So finally my family got a PR and moved to Canada too. Coming to the point my PR card is going to expire on 1st Feb, 2015 and I can meet RO by the time, however I heard when calculating RO, we should consider the no.of days stayed in Canada from the day got PR (first time landed in Canada ) to 5 year calendar i.e fall on 1 Jan 2015.

Is that right ?

It is correct that you must meet the RO in your first 5 years as a PR and in any rolling 5 year period after that. However, if you are in Canada now and not planning on leaving any time soon, as long as you don't apply for anything from immigration, the chances of getting caught because you didn't meet it in the first 5 years are minimal.

When you apply to renew your PR card, they will look at the previous 5 years from the date of your application so if you apply Feb. 1st 2015, they will look at the period between Feb. 2nd 2010 and Feb. 1st 2015 and if you meet it for that period, you are ok to apply. If you don't, you should better wait until you do.
