Question about Inland/Tourist visa?

Good afternoon, I need some assistance please. My wife is currently in Canada on her tourist visa which expires January 3rd, 2015. We got married in Serbia in April this year and I am a Canadian citizen. We filled out papers for work permit/inland application for her to stay in Canada but its still a long way away (Sept 17th, 2015). I know you have to re-apply for her tourist visa extension 30 days before the visa expires and its fastly approaching. I am currently doing her papers right now and on IMM 5409 its asking Statutory Declaration of Common Law Union but we have a marriage certificate. Do i need to fill out this paper? Just because under solemn declaration its asking for a person who administered the declaration and that person is not in this country.

Please help me out with this, I am confused on what to do.

No, that's only for common-law and you are already married.

As you included the OWP app with the inland PR app and she had valid status at the time, she does not need to extend her visitor status. She will have Implied Status after her visitor status expires until she receives her OWP.

He's right, she'd be under implied status when the visa expires. You already sent the app in Sept? She shouldn't have to wait more than a couple months more for the OWP.
