Hi,
Kindly need help,
we did our landing on June 2009 and stayed in canada for two week.I came back on July 2012 and my children went to school. My PRC will expire on July 2014 and we need to visit our family backhome before our PRC expire. I will travel on first of March2014 and come back end of March 2014.My quations will we be able to enter as some saying that we can't enter if our PRc will expire in less than six month and that the machin at the airport will withdrow it??what we must do in this case ??we need to enter Canada and stay as I am renting a house and my children are in school.

Yes, that is rubbish, there is no 6 month rule. However, if you landed in June 2009, stayed for 2 weeks, left again and did not return until July 2012, you have already spent 3 years outside Canada since you landed. That is the limit when it comes to meeting the residency obligations. By leaving for a month now, you will be risking your PR status. If immigration becomes aware of your breach of the RO as you re-enter Canada, you could be reported and you could possibly lose your PR.

Therefore, it would be preferable to stay your 2 years, meet the RO, renew your PR card and then you can take a vacation in your home country for as long as you want (well, up to 3 years anyway).

what about if I travel for only 2 weeks can I stell meet my residency obligatios as if we count from July 2012 to July 2014 it is 2 years so I can renew my PRC without any problem.Is that possible ? and to let you know I was reported when I came on July 2012.

You are making a common mistake. The residency obligation requirements started on the date that you landed. They are nothing to do with your PR card expiry date. If, in the 1825 days from the date of landing, you have not, or cannot, claim 730 days of physical presence inside Canada, you are in violation of the requirements. Therefore, you could be reported, even if your PR card is not expired.

You have to spend 2 years in Canada any 5 year period. That means you can be away for max. 3 years.

In order to count your 2 years, you can not count from June 2009 until July 2014 because that is 5 years + 1 month. You have to meet the residency obligation for June 2009 until June 2014, from July 2009 until July 2014 etc. for any rolling 5 year period.

If you were already outside Canada for 3 years after landing as a PR, you have used up your outside allowance and so you must stay for 2 years straight to make up for it.

It depend on officer and your luck. You can use self check in KIOSK at airport but randomly at the end of the line IO check your passport and PRC. It is a gamble.

In some airports, you scan your PR card yourself through a machine. However, there is still an immigration officer at the end of the line checking. I have heard of people being picked out of that line for further review so it is not a foolproof method of avoiding it.

I landed on 20/6/2009 went back on 10/7/2009
I came on 12/3/2012 went back on 23/3/2012 but with out the children.
I came finally on 20/6/2012 uptodate.
Will they count days in 2009 or only days from 2012?

They will count back 1825 days from the date that they receive your application. Any days that you were in Canada within that time will be counted. If you landed less than 1825 days ago, they will give you credit for the missing days.

With these travel dates, you have 1063 days outside Canada since you landed and within the past 5 years (2 absences of 975 and 88 days). You can renew your PR card if you have less than 1095 days outside. Therefore, you are not actually in breach of the RO right now and you could actually take a short trip in March without breaching it although you would be very close to the limit if you stay outside for 30 days. What you could do instead is apply to renew your PR card right now and travel when you get the new one.

Do you know which number CIC use to define the RO period; 1825 days or 5 calender years from renewal date? If the OP applies uses the period 29-June-2009 to 29-June-2014 in my calculations that's a 1827 day period where as if a 1825 back-calculated day period is used from 29-June-2014 that gives a period starting from 1-July-2009 so they would loose a couple of days. I'm being pedantic but if the OP is depending on those days it could cause them problems.

I don't think they count leap year days which can help you or hurt you depending on if you were inside or outside Canada on those days.

The PR card application asks you to count your days outside Canada, not inside. If you have 1095 or more outside, further explanations are needed. It would therefore be smart to make sure you get nowhere close to 1095 days outside. The OP has 1063 days outside right now since their landing which is fine. In their shoes, I would not risk another trip until after PR card renewal.

Can I do that ( What you could do instead is apply to renew your PR card right now ) even if I dont have 730 days inside Canada.
