PR staying outside for 3 years...now returing but getting deployment outside

Hi members,

I have been out for 3 years on PR and now planning to return to Canada. I have Canadian company offering me job but deploying outside Canada.

Is that is fine to maintain PRO ?

Seek you expert advise.

It's difficult to say. Normally CIC prefers / expects you to be hired for a role in Canada. And then after working in Canada for a while you are then transferred by that company outside of Canada.

What kind of job is this? What is the company? Is it a large and well established corportion (e.g. tens of thousands or hundreds of thousands of employees)?

Hi Scylla,

Its renowned Shipping company in the world with more than 10K people worldwide. They are planning to deploy me outside canada but appointment letter will be from Canadian arm.

Is it possible to work outside and still maintain PRO.

What about my wife...even she is also outside Canada since last 3 years..

Is it a Canadian company with branches in other parts of the world? Or an international company (i.e. not originall Canadian) with branches in Canada? If it's the second, then CIC may say you're actually being hired by the parent company and the fact that the appointment letter is coming from the Canadian arm really means nothing since you will be working outside of Canada.

If it's important for you to keep your PR status, I would consult with a very good immigration lawyer before accepting this job.

I agree with scylla about getting professional advice. Even though it is possible to work abroad for a Canadian employer and have the time count to PR RO, CIC is very strict about this type of job. They have a very narrow viewpoint on this. Unless you work for the government in a position abroad or are stationed abroad in the Canadian military, it is very unclear how CIC defines what is acceptable and what is not.

Where is the Registered Head Office for this company? If its not in Canada then its a hard sell. Read the forum and see the experiences of others that took up job offers without clarifying the RO aspect. Ask yourself the question - If the manure hits the rotating air mover and I lose PR will this employer still want me?

If your employment is accepted, you will meet the RO and your wife too as your spouse accompanying you. However, as others have said, immigration is strict in regards to who is considered a Canadian employer and even how the job came about.

Sometimes employment can be borderline and they might still let you get away with it but there are different scenarios. Say you had lived in Canada almost 2 years, you get that job and get posted overseas, they might be more inclined to let you slip than say if you spent 3 years outside Canada and then arranged a Canadian employer to post you overseas right away. Immigration will see it as a lack of willingness to settle in Canada and and attempt to keep your PR without spending any time here.
