Hi there!
I definitely need your advice. My husband is already has PR. We've got married and applied document for spouse sponsorship within Canada, so I'm applicant. There're two questions about it.
1. Could my husband leave Canada because of business trip while the whole process is not finished yet (we didn't receive so far approval of sponsorship itself neither my PR). I've heard that he can leave Canada only after 1st phase...
2. Could I leave Canada after 1st phase approval? I mean when my husband will be approved as my sponsor.

Thanks a lot for your help in advance

Lana

A PR has to remain in Canada while he is sponsoring, and if your doing an inland you can leave but you risk not getting back in if this happens the application will be null and void.(gone)
So no your husband can not leave for the whole process he cant even leave after first stage as a PR.
If your doing an outland and he is sponosring you ,you can leave but also risk not getting back in until you get your PR.

1. Yes your husband can leave for a short business trip throughout the PR process. He just can't be gone for a long time. I am not sure there is any set rules for how long is too long, I would just use common sense. Since its for a business trip he should be able to have some sort of paperwork from his employer stating the reason for his trip. The whole "PR must remain in Canada while sponsoring" is mainly to try to make sure that the sponsor is going to come back to Canada and both intend to stay in Canada and not just use it as a way for the applicant to come to here.
2. Its not advised for you to leave Canada because if the border agent doesn't let you back in your PR application is voided out. People have done it in emergency situations but its at your own risk.

This is only true if you have applied via the inland process. An outland application is not affected by your residency.

she used the phrase "first phase approval"...this is generally only used in an inland application, so I made some assumptions on her filing status. :)
