May isa pa po akong question. Yung sponsor lang po ba usually ang nakareceive ng AOR2 from CIC?

Hello guys..sa mga naghihintay po ng ppr..malapit na po yan..january applicant here..nov 24 ppr...nov 29 VOH..Dec 2 landed..kahit mahigit 9mos po hintay ko ng ppr parang hindi mo maiisip ang tagal sa paghihintay kapag ppr na Parang ang bilis lng ng panahon

Applicant po kayo? Kasi si hubby ko siya yung sponsor nagchange siya ng employment and we never update cic nor mvo..sa aor2 po si hubby po nakareceived (sponsor)..pero yung iba na nababasa ko dito minsan si applicant nakakareceived..yung aor2 po was the emailed received my sponsor from cic po..yung iba naman na aor2 is the email receive from mvo

3 weeks ago, nakareceive po yung husband ko ng e-mail saying that my application was already transferred to MVO. Ano na pong next?

i don't think anyone is supposed to take any child with his/her father's name out of the country without his consent, right? especially if the father's name is in the birth certificate. it would be unfair on the part of the father if his child is gone without him knowing.

you would need a court order for things like this.
I think it depends. It is always a case to case basis. Some single moms decide to still let their child carry the last name of their biological dads even if the latter hasnt been able to be a dad and take on responsibility, believing and respecting the child’s identity. Under PH Law, a single mother exercise full parental authority and that includes bringing the child out of the country even if the child’s last name is after his/her father esp if the child is below 7 years old. The only exception is if the mother is unfit as ruled by the court.

Sorry to say but there are a lot of “fathers” out there who arent “real fathers”. That being said, it is proper and just that they should not be given any right even if the poor child carries his last name.

i am one those poor child. i never had a father. i carried his last name. i got married and now my wife carries his last name too. im sorry but what you say is not true at all according to PH law.

Art 176 of Family Code says that "Illegitimate children shall use the surname of the mother and under the parental authority of the mother..."

if you did in fact use the surname of the father and the child is still considered illegitimate because the father did not acknowledge or recognize the child, then that means the mother still has exclusive parental authority over the child.

but i don't think any of these statements is true for the above situation, isn't it? first of all, the surname of the father was used. second, the father recognized the child and his name was even on the birth certificate. so in reality, even though the child is illegitimate (born out of wedlock), the mother has no exclusive authority of the child.

please read on RA 9255 for further information.

Hello po, I received pre arrival last month then PCC, RPRF medical request. Lahat po ay tapos na. Tanong ko lang may posibility parin kaya marefuse ang application for PR kahit nakareceive ng Pre arrival letter? Nagkulang kasi kami ng wife ko ng $200 LICO sa 2012 income namin then trinansfer nila yong papers namin sa MVO for final and reconsideration then nagasked sila ng another evidence na makakatulong sa apply ng parents ko for PR kaya nagsent kami ng 2015, 2016 NOA. then after 8 mons I received pre arrival taz sumunod ang PCC,RPRF at medical for my parents at mga kapatid ko. So not sure kung may possibility parin na marefuse dahil sa Low LICO namin for 2012.

Whether or not the child was acknowledged, for as long as it is born out of wedlock, the child is always illegitimate. Under the Tender Year Rule, a mom of an illegitimate child who is seven years old below, will exercise exclusive full parental authority. You cant find that in the Family Code, because this is a principle laid out in PH Jurisprudence, which I have studied for four years in law school.

Not true about "....that includes bringing the child out of the country..." If the illegitimate child is migrating esp in Canada, acknowledged by the bio-dad and name shows on BC, IMM 5604 is a must. Unless otherwise the mother could show enough proof that will convince the VO why she can't provide the said consent form.
