Same question, what is your status in Canada?
This section "Permanent Residency Obligations" is for PR of Canada to discuss about their Obligations (mostly on the physical days spent inside Canada as PR).
If you are not yet a PR, you are posting in the wrong section.

If you are an internation student, then you could apply for TRV/SOWP/study permit for your immediate family BUT the approval is never guaranteed.
If you are the mother of your child, it should show in the child's birth certificate. I don't understand what is the "custody documents" you needed since the father already passed away.
For your spouse, you need marriage certificate.
I am an international student.

If the father is still alive, even if you were never married, then you still need that IMM5604. Hope all works out well for you.

EDIT: Some countries like the Philippines award the mother automatic sole legal custody of illegitimate children. As I'm unsure about your circumstance, I can't comment further.
Hi. I received an ITA and is now collecting documents for our PR application. I am a single mother, was never married and the father did not recognize my daughter in her birth certificate. I am from the Philippines and yes, you are correct we are automatically granted custody for our child. My daughter's father's name in her birth certificate is blank and has no name on it. I am already here in Canada and my daughter is in my home country. I have the following questions:

1. Do I need to declare her father and her siblings in my daughter's family information?
2. Do I have to fill up the IMM form you mentioned earlier? And where to upload them?

So in Pakistan HOW THE CUSTODIAL PARENT UPON SEPARATION OR DIVORCE COULD OBTAIN FULL CUSTODY OF THE MINOR?
Under Section of 7 of the Act, 1890
, person in custody of the minor is required to approach the court seeking issuance of Guardian Certificate. This help the custodial parent to attain a trifecta.
By filing the Application it is established in court that the minor is genuinely in the custody of the applicant.
By obtaining Guardian Certificate, applicant if mother do not require, consent of father for issuance of ID Card, Passport or Birth Certificate of minor from NADRA. She can also travel abroad with minor without consent of father.
So all you need guardian certificate which means you are legal custodian

Hi, Good day to all. Im so grateful to be find a forum for such great informations.

I hope you could help me with my inquiries. I am a single mom from Philippines . My son is illegitimate at birth and haven't heard about the father of my son. Now immigration is asking me to fill out the IMM5406 for non accompanyinhg parent and legal custody document. I have submitted an explanation about it but then they ask me again for second time about the form and custody document. I really don't know what to do? Ive read that when you're from other country like Philippines you don't need to go to the court for the custody document. Please help me, They gave me one week to provide for it. Should I resend my explanation letter. Please help me. Thank you very much.
HELLO, could you please confirm if you submitted the explanation letter again and if you were successfully able to get PR?

My pr application is still on process and so far IRCC has not asked any document for legal custody, and i hope they will never ask for it...i included in tje letter of explanation about my back story and my child's birth certificate where the father section is n/a...

It's the same with us. Birth Certificate has N/A. Could you share what exactly what you wrote in the letter of explanation and if you attached any affidavit?
I just wrote that the father did not acknowledge paternity and left me when i was still pregnant and i was not in contact with him after..which stage are you now? And which oathway? Im on PNP-EE (CEC).

Did you put the father's detail under the child's application? I mean in the field where it asks for family member of your child? Because i did not put it..and just put n/a.the reason also why i made a letter of explanation why my child's family information was blank

Thank you for asking! Mine is BCPNP Non-Express entry. Next week, I am going to marry a girl from Philippines. She has a kid out of wedlock and the father's name is not mentioned on the Birth Cert. It says N/A. The guy, child's father, left her when she was pregnant and have never had any kind of communication. My fiancee told me that she has never entered the father's name on any application due to this reason.

So after I get my marriage certificate, I am going to apply on the PR portal with them as my dependents. They are currently both in Canada on open work permit and visitor visa respectively.

What do you think abt our case?
