Hello guys,

I have a question regarding Employment requirements and job posting.

If a noc code, for example NOC 1226, does NOT require a master's degree according to Human Resources and Skills Development Canada
but my employer ADD this (master's degree) as a requirement to the job posting.

Is it a reason for refusal when applying for LMIA?

Thanks,

It could be reason for not accepting the LMIA application as job requirement need to be posted from HRSD.

However your employer can describe either Masters or equal amount field experience.

Its always better to check with Service Canada.

Thank you for your reply.

Has an employer the right to post a job advertisement requiring from the candidate to have a master's degree for a position that according to HRSDC it is not necessary for this position?

100% an employer could post PHD (just saying) when designing job requirement.

CIC will only see if it meet minimum job requirement from Human Resouce CIC.
