Please don't forget that physical presence calculator verifies eligibility criteria of number of days present in Canada but there are other eligibility criteria and filing taxes for past 3 years is one of them.

But if you wish to apply on Jan 18, I suggest you attach a explanation sheet with your application saying that T4's etc are not available till late February and that's why you haven't filed the taxes for 2017 yet but you will be filing them once they are available and they might consider your application but again I'm no expert in that and it is just a suggestion.

There is nothing wrong with your wife's application. She did file for 3 years (2014, 2015 and 2016) and all the employees at cic knows that one cannot file for 2017 until late february, so nothing to worry about. In fact, my wife application which was delivered today has the same scenario, She filed for 2014, 2015 and 2016 and for 2017 she added a explanation sheet saying that she will be filing it once T4's etc forms are available.

The scenario with Lindsy77 is bit different than yours. She was not in Canada for the entire year of 2014, she came to Canada in January 2015 and therefore doesn't have any income tax filed for 2014. So her past 3 taxation year includes 2015, 2016 and 2017 and that's what my post was about.

I've been seeing a lot of threads and comments recently about people worried about their 2017 tax returns. I don't think there's anything to worry about. If you are applying now, and have not done your 2017 taxes (because of course you haven't - nobody has), just tick the "no" box. You're allowed to say no to things on the application that you don't have, because that's the truth. You still qualify with 3 previous tax returns. And by the time CIC gets around to actually looking at your application and cross-checking with CRA you'll probably have filed anyway. Which doesn't even matter because you'll still qualify regardless!

There's too much stressing going on! This is the "easy" part of the Canadian journey guys! We all struggled through the uncertainty of trying to get PR that I think the stress of dealing with CIC again has been re-triggered in a lot of people. Whether this process takes 5 months or 5 years, we're not in danger of losing our work permits or being deported because time ran out. Faster would be nice of course, but the stakes are lower. Just answer all the questions honestly. The requirements are all clearly spelled out, and if you meet them you will succeed in time. :)

Lol I panicked. I left work early and rushed over to Fedex and pulled my package before I read the replies as I didn’t want to be in a situation where CIC returns the application. I also ran through the CIC questionnaire with respect to eligibilty and they ask if I was required to file taxes to which I said Yes and then they ask if I field all the taxes then i said no as we havent filed 2017. Then it jumps to the conclusion that we may not meet the eligibility for citizenship.

So I imagine there are lots of people in the same boat. Do we even need to write a letter stating why we didnt file for 2017? Should be self explanatory to them right?

I'd imagine so. I guess a letter wouldn't hurt if you're worried, but CIC agents aren't robots (even though they might seem like it sometimes, LOL). They get an application dated in January 2018 and they can't possibly expect you to have filed your taxes, and they aren't going to reject every single application received prior to February are they? I'd bet you this is precisely why the requirement is to file 3/5 years... so that there isn't a 1-2 month period at the start of the year where it's technically impossible for anyone to apply!

Also, the citizenship application is not a self-assessment - they're going to contact CRA and check that you're eligible. No matter what you ticked or said yes or no to... they're going to check.

The worst thing people can do is to tick yes when they haven't done their taxes. That's probably the only way that an actual problem could be caused!

If you dropped it off after noon on Friday, it probably got picked up today. Should see some update tomorrow, assuming they didn't cancel service today due to bad weather. On the other hand, you can request for a refund if it doesn't get delivered by end of day on Tuesday.

i am applying for my minor son. the check list ask for my son's birth certificate with his name, dob and parents name. Now my son's birth certificate from new delhi does not have his name on it. for this reason some one suggested that i should attach a certificate of birth from Indian embassy along with birth certificate (without name) towards this document requirement. Kindly suggest if that is ok.

Hi Anshul,

As far as I know, Indian embassy issue birth certificate based on information mentioned in your passport. so they will just write down the name, place and date of birth from your son's passport which should be okay in your case as you do have your son's birth certificate. I think that these two documents should be good enough for you to proceed. Good luck.
