Read it and see for yourself the criteria they use. a red flag doesn't mean a relationship is fake, just a sign they look for that makes them question more a case.

I researched a lot about this inland PR application and I was confused. I knew all the details but still we travelled and worked in different countries where we had only a few proofs of cohabitation (we never signed a lease contract while abroad), my wife just returned to Canada less than a year ago and she didn't declare taxes because she was abroad. So we were confused about what to declare in the form. Also she has student loan that we didn't know if it was going to affect our application.
For peace of mind we decided to go to the immigration consultant.

What he said to us was (it's all in the form I guess but I list because those are strong points for immigration officer). It's mainly a list of positives/negatives:

*Declare if you had any previous common-law and/or were married before. He made a point of not lying about this even if it could "hurt" the other person.

*It's positive that we lived together for at least one year.

*Not so positive that we stayed apart for 3 months, and we needed evidence/explanation that our relationship was continuing.

*Not so positive that my wife is older than me, 5 years are not a lot, but it also depends on other things (duration of relationship,evidence of trips together, meeting relatives and friends, supporting letters etc..), so this could be considered "neutral".

*Positive that we are living together and both our names are on the lease agreement.

*Negative that we don't have a joint bank account together. But we provided evidence that we tried (I don't have a SIN number so I can't open a bank account nor she can add my name to hers), so it should be ok.

*Positive that she changed her surname with mine with documentation ( Alberta drivers licence in our case)

*Positive that we both have a will mentioning each other in case bad things will happen.

*Positive that I met her parents and she met mine, with evidences/photos provided.

*Negative that our marriage was not attended by both our families. We explained that we didn't want to make anyone unhappy (my family could not have attended and her parents live in USA), so I guess was ok.

*Positive that the marriage was a really simple ceremony but not kept secret but announced with cards and "celebrated" at a restaurant with our friends, our niece and my wife's brother.

*Positive that the circumstances of our meeting, the trips/travel we've done together, and our "story" was supported by letters (and photos) from our friends, employers, relatives.

*In question 12 of the spouse/common-law questionnaire is important to make a point about the future plans with your husband/wife in the country. We said we would like to stay in Calgary and buy a house once we have two incomes and then starting a family.


For sure there is more, but this what was on top of my mind now :)

Thanks a lot, it is useful to know this because it helps me know if I did the right thing as well. My case has about three negative points, but it has more positive points for sure. I'm wondering how they weigh these things. we did include plans of our future and there's also more new evidence coming out as time passes. we're buying a Condo etc.

I remember another thing the consultant said:

he made a point about not working while waiting for the 1st stage (I applied for an OWP of course) but ALSO not volunteering because it's considered a "grey" area, because a person could gain indirect benefit (letter for future employment/experience in his professional field/promise of future employment). He said it's safe only in organizations like the Red Cross etc.

I finally got my UCI number. after 4months. ;D

but why they sent the email to my sponsor, not me?

anyway i tried to log in with the UCI in the website, they said they can't find my information. why? :eek:

jbel,i know its stressful,but just wait for a week or 2 and try and again ,maybe the would started processing....good luck

Anyway I was planning on doing some volunteering too but I can't, Red Cross is not my kinda thing. Besides that me and my wife don't want to take any risk of screwing up our application.

It was the same in my case, they received our application on October 12 2011, they sent an email only to my sponsor on Dec 22 2011 with UCI, and we could both access the E-cas about 1 week after that. You'll be able to see your name on E-cas, even if they haven't sent you an email.

Hey guys, hopefully someone can give me good advice. I am posting this on behalf of a good friend of mine who will be sponsoring her husband inland hopefully this year, but because I am so familiar with this site, I am helping her get info.
Here is the details. Met July/2009, married July/2010. She is Canadian born with Jamaican/Trinidadian parents, the spouse is Jamaican. He came to Canada in 2005 on farm program and ran off so he is here without status. She has 6 yr old twins from previous relationship, he has 4 children in Jamaica from 2 previous relationships. She has a decent job. He works for cash with some of his family members.

My question is, what info can I give her to help guide her. I think she is facing a few challenges. For one all the medicals for his children have to be done. Plus they had a splash wedding that left them in real financial debt, and one more thing, she sponsored a previous husband to Canada (from Jamaica ouland) and divorced him like 2 months prior to her wedding. That sponsorship is now finished but I am wondering if CIC will look at that as an obstacle. Also he did fingerprinting but has not submitted them yet. I know the police clearance takes a while and cannot be done more than 3 months before app is submitted, but is that the same for the rcmp check. I am assuming he will have to submit police clearance from Jamaica & Canada correct?

I am no expert but to me a previous sponsorship is a red flag for the immigration officer. It's clearly stated in the guide for "inland spouse/common-law sponsorship" that you may not sponsor if:

•You have an undertaking for a previous spouse or common-law partner and three years have not elapsed since he or she became a permanent resident
•You receive social assistance for a reason other than disability
•You are in default of an undertaking, immigration loan performance bond or family support
payments (Refer to the Defaults section below)
•You are an undischarged bankrupt
•You were convicted of a sexual offence or an offence involving family violence, unless you were granted a pardon or five years have passed since the completion of your sentence
•You are under a removal order
•You are detained in a penitentiary, jail reformatory or prison
•You have already applied to sponsor your current spouse or common-law partner and a decision on your application has not yet been made

As for him having "no status" I have no idea how it is going to affect the application.

Thanks for your response but I also stated that the previous sponsorship is finished as in the 3 years have passed. :)
