I don't know why you're saying I'm misleading people!!! Different interpretations, different perceptions!
Procedure 9.5 reads: "Before placing the application into processing, review the information on the file and determine whether it meets the criteria in the Ministerial Instructions. To be eligible for processing under these Instructions, the applicant must qualify under one of the three categories described in the Ministerial Instructions"
Procedure 9.6 reads:"Where documents are reliable and information is clear, consistent and well-supported the final determination of eligibility can be made quickly. Where this is not the case, the final determination of eligibility will be more involved.
While visa officers must exercise diligence at the final determination stage, they should also complete this stage quickly, i.e.
ideally less than two weeks after the deadline set by the CIO. "
We need to differentiate between Eligibility for Review and Processing. This is what the procedures explain.
Once eligibility is established, which is before processing, pass marks are confirmed. At processing phase, the VO will authenticate the documents applicants provide...,then, if any of information provided was concluded to be wrong, then, the applicant will be inadmissible by misrepresentation. This has to be very clear.
We all need to realize that eligibility review is a critical milestone, because simply, once it's positive, then, no refund will be given. Same procedure 9.6 reads "After a positive final determination of eligibility at the visa office processing begins and the applicant is no longer eligible for a refund. "
