Dear Forum,

My first post ;D, im applying for FSWP and completing the documents and getting ready for the re-opening of the program. my question is about imm 5409, i've read a couple of threads regarding this and makes me confused as to include this or not. I'm married, and as per the threads i've read, i do not need to include this form, but others are saying that they'd included this just so that they've complied in completing the checklist (even though they're married!). Please advise, thanks!

IMM 5409 is the statutory declaration for common law union. As you are married this form is not applicable to you.

In order to qualify for Statutory Declaration of Common Law Union Application for Canada, a common law partner is defined as:A person who is living in an unmarried relationship with another person (opposite or same sex), and has done so continuously for a period of at least one year.

Hi it you are not applying with a common law partner, then you do not need to fill this form in. IMM008 already demands if you are applying as single applicant or couple, so the followinf applies for the IMM5409.

Single applicant * Not Married * No Partner - then you do not need to send the form IMM5409 however I would send it and mark the form NEANT just to be covered.

Couple Married - No need to send as you will need to send your marriage certificate (copy) with the supporting documents however I would send it and mark the form NEANT just to be covered.

Couple Not Married but living as if married - then you need to have this form filled in and sent with the application package, we did this at the local Canada Consulate. You will also need to provide proof that you have lived together for more than 12 months at the time of applying.

Couple *Not Married and not living together - In this case it is very difficult to say what to do as you need to proove that you have lived together more than 12 months.

As always this is my interpretation of things, but nothing is better than contacing CIC enquiries in Nova Scotia
