Hello, as a Canadian permanent resident I must spend 2 years (730 Days) out of 5 years inside the country in order to keep my PR status. My question is: If I've already spent my first 2 years here (of the total 5 years period, since I received my card) Can I stay outside Canada for the next 3 years then come back, renew my PR card (takes like 2 months) then leave for another 2-3 years and come back to spend the last 2 years of the new 5 years period here to meet the requirement? That would be like 5 or 6 years OUTSIDE Canada in a row (almost since I will come back to renew it) I was just thinking about this method I hope someone can help.

In every 5 yrs. cycle u can reside away from Canada for 3 yrs. U can continue to do so till eternity & remain a PR all your life.

BTW, why do u want to do that?

In reality you might be able to do that but technically you can't.

Using a 10 year window from the scenario you painted, when you come back in Year 9, you will not be able to meet the 2 year residencey obligation within the previous 5 years. In other words, from Year 4 to Year 9 you will have less than 2 years. So even though your card is not yet expired, you are technically no longer a PR.

As alabaman has indicated - no - you can't do that. It's a rolling 5 years.

Right, it's a rolling 5 year period so lets say that after the first year of the 2nd 5 year period, you are now 4 years out of Canada, you lose your PR card and must apply for a travel document to get back. They will look at the 5 year period immediately before you applied for the travel document, see that you are outside Canada for 4 years in that period, deny you the travel document and revoke your PR.

The '5 rolling years' makes me pretty confuse about the PR obligation, i asked this before but still not sure about it, have to make sure. I've landed on Sep3,2008, stayed in Toronto for 1 yr and 4 months right after landing. Then went back to my own country on Jan 2010 for working. Plan to go back Canada on Oct 2012 and stay for the remaining 8 months in order to renew PR before Oct 2013 which is the expiration day...can i do that? Also, the 2 years in the 5-year period must be the 2 years after i've got landing paper, not any days im on student visa, right? Thanks!

Ok, your first 5 years at a PR, since you landed, you must spend at least 730 days in Canada.

The rolling 5 year period after that means that on any day, you must be able to look back at the previous 5 years from that day and say that you have been in Canada for 730 days during that time.

You need to have 730 days in Canada between Sept 3rd 2008 and Sept. 3rd 2013.
