Got a letter from vienna about travel document refusal need advise!

Hello, I got my letter from Vienna Visa office today. I asked them 2 weeks ago to relinquish my status as a PR because I want to re apply under the FSW2014

Unfortunately they did not accept my letter stating that I wave all appeal rights. They sent me a form to in case I want to appeal the refusal of the travel document.
Which means if I dont sent this document I will loose my status as a PR around the mid of July right??

I will have my application for the FSW2014 ready mid June.

Can I just sent it or will they refuse it??

They did accept your letter, however they are going to wait the full 60 days, just in case you change your mind. It is more a protection thing for both of you. If they should close your file now and take away your PR and you later, say in 45 days say "Hey, I wanted to keep that!" then you have a case against them. They aren't going to allow that, obviously.

I think you should be fine to go ahead and mail your application in mid June as planned. What will happen is when they begin looking at it to analyze it, they will see you are still a PR and then will ask to have that issue resolved first, which you have already done, you are only waiting for it to 'complete' by timing out. I don't think you will have a problem at all, or at least that is my understanding of how it all works.

If you are eligible to apply under FSW, go ahead and apply in June but send a letter to them explaining the situation with your old PR and refusal of travel document and upcoming loss of it in July.
