hello,everyone I was new on this forum !My husband going to be file bankcruptcy while waiting passport request! Our VO is MANILA PHILIPPINES!Is could be affect in our application? PlS. NEED helped here,..very stressful sitaution! Answer would highly appreciated...THANK YOU

if you are just waiting for the passport request then i suggest you can ask your husband to maybe wait a bit to file bankruptcy?

the sponsor needs to be financially stable, from what i understand.

Welcome, and try not to stress it (I know that's difficult) but you have a options. Previous poster suggested just wait a bit before he files, and secondly, if he's "approved" as a sponsor then he's APPROVED, (I'm assuming that has happened already). The Manila VO is too busy and not likely going to re-visit his financial situation, not from way over there. We'll see what other input is provided but either way, you now have two scenarios.

I work in a insolvency office.. we deal with bankruptcies.. proposals.. legal debt..bank loans.. etc etc

CRA ( Canada Revenue Agency ) and OSB ( Office of superintendent of bankruptcy Canada ) do get informed about the person filling the bankruptcy.

from what i understand during my process of sponsorship is that.. the sponsor has to be able to financially support the spouse for three.. so i dont know how that will work out.. if he is filling for the bankruptcy himself.. how will he manage to support you? .. i am sponsoring my husband from pakistan. i am not sure if your visa office have the same rules or not.

The only option, as I see it, is to wait to file bankruptcy. Once you have landed, go ahead with it, but are you sure there are no other options? In other words, is it absolutely necessary for your husband to file bankruptcy? This will have a major impact on your future, so I'd advise looking into other alternatives before going all in...

i agree,
bankruptcies have major impact on your future.

consumer proposal will also take all the debt away.. well it depends how much debt he has. and these proposal are not as bad as bankruptcy.
but still. i would suggest to wait for some time before filing the bankruptcy

I would seek advice from a professional debt consultant. A debt proposal is a good solution as it is a agreement with the entities he owes money to to have fixed payments for 5 years. They slash in return 50-60% of the owed amount as they know that in case of a bankruptcy they see nothing from the owed money. A proposal does not affect your immigration application and is a bit easier on your credit rating with 6 years instead of 7 years in records. I highly recommend to seek advice from a professional and filing a debt proposal. That way you can be sure your immigration process is not affected.

A sponsor cannot be in undischarged bankruptcy proceedings during processing. If your husband is your sponsor, he should wait until your visa is issued before he files for bankruptcy. In the meantime, he should definitely look into options like a debt management plan or a consumer proposal instead - reasonably sure these would not make him ineligible to sponsor, but a bankruptcy would. Have him check with Credit Counseling Canada - and be sure to tell them he is in the process of sponsoring a spouse.
