AOA all,
I have applied in category 2171 and 2172 as i have about 10 years of experience as Systems Analyst abd Database Administrator

I applied on July 25 2008 and my e-cas is showing status that "your case has been received on <date>".

Initially it showed case is in-process and your application has been sent to Nova Scotia C-50 and they may contact you but then it was changed to application received without my mailing address, and only a few weeks ago it again started to show my address.

Nobody knows what will happen to cases like mine.

I am a constant reader of pakistan application forum and it is very informative.

Hi Everyone,

In it, I put something interesting about how CIC dealt with such incidents in past. Several years back, there were similar situations where because of challenges made by applicants, the court ruled in favour of those who were being retroactively rejected by some newly created laws. Firts Of all for the Guys who fall in those 38 profession.

You must write to CHC, Islamabad and email them immediatelly, Bec according to my view they have completed and shortlisted those person till the end of january, 2009 and allready send them a documents submission request. Please also consider that i lost my Letter which was sent to me on 31st ,January 2009 and just after sending them an email in Febuary, 2009, they send me the duplicate of that letter and i allready lost 60 days in that period. But in anycase please write them immediately and email them and fax them by mentiong that you fall in those 38 professions and have not recieved any further correspondence.

Secondly for the Guys Applied Feb008- Nov, 2008 Dont fall in that 38 professions, i suggest keep waiting, I dont remeber the link but once i read back in 2008 that they will retain certian application which professions they forecast have potentional Demand in near future. I dont know what happend with that statement. It was that read at www.cic.gc.ca at media link. But sorry dont remeber the press release or information.

Thanks Hot-Lier. Probably you are right they might have selected some applications which have demand in near future and not in the 38 list now. This may be a reason for delay in reply regarding that applications.

What other members think ?

If you have applied between Feb 28, 2008 and Nov 28, 2008, and your profession is not on Magic 38, You application will be refused and application fee return. CIC has no policy of retaining anyones application not on 38 profession list.

This whole so called HIGH DEMAND 38 profession list is a way of getting rid of backlog not building it further.

the Ministerial Instructions were made public

You realize of course that those instructions refer to applicants who didn't have 1 years experience in the "list" on the date of application after 28/02 but before 28/11 but now do, and those applications whose experience on the list is over 10 years previously 28/11 but was within the 10 year period when they applied? It would be a very small group of applicants.

Thank you for your enquiry regarding immigration to Canada as a skilled worker and the current policies and procedures relating to the assessment of applicants in this category.

Federal skilled worker applications received on or after February 27, 2008 are now assessed for eligibility according to a set of instructions issued by the Minister of Citizenship, Immigration and Multiculturalism. More information on this is found at http://www.cic.gc.ca/english/immigrate/skilled/apply-who.asp.

If you applied before February 27, 2008, our office will contact you and ask you to provide the required documentation when your application is due to be processed. When we have verified your completed application, we will send you a letter to tell you what you need to do and what happens next. We are currently processing applications that our office received in 2004.

If you applied on or after February 27, 2008, you will be contacted with more information on your application. If you submitted your application and it is determined that your National Occupational Classification code does not fit into the list of occupations that qualify for the purposes of skilled worker immigration to Canada, you will be so advised in due course and your processing fee will be refunded.

Should you have an application in process at our office and decide to withdraw it and reapply (in the case of skilled workers, directly to CIU Sydney), please be aware that your application will be assessed in accordance with the Regulations in effect at the time of your new application. A new application, for processing under the current criteria, may be submitted at this time although another application submitted prior to February 27, 2008 is still in process.
