you can not live in Canada without a status if your visit visa or work permit is expired and you are still here in Canada illegally this might effect all your future applications including your sponsorship application.
if your work permit is expired recently then first you need to apply for restoration of status ( A must thing todo). you can apply this online and most likely you will get approved if you can prove your relationship and your plan to submit a PR application ( status of your partner will help explaining more. wot id his status here in canada).
once you restore your status (i.e as a visitor) you can choose to apply for an outland or Inland application. if your restoration is approved you will be allowed to stay in canada till your visitor record expires and you can extend your visitor record again when it expires on the basis of your partner and your pr application.
in case of outland yes interview will be most likely the last step of your PR and no harm in going back for 1,2 months.
Advantages if you apply for Inland sponsor:
-your restoration of status and visitor visa extension will be easy.
- you will be able to work here as you will be instantly eligible to apply for a work permit. (pilot program OWP for spouse started in January 2015)
- you will be having less complications as you already gone out of status. ( your biggest mistake, you should have applied for extension or change of status before your work permit expires)
- Timeline may be a bit longer but good part is you will be in canada thus less stress and easy waiting timings.
- your settlement will be smooth as you can work, have a driving licence, health care etc ( depending in which province you are living)
Conclusion and recommendation:
-Staying in Canada illegally will create a lot of complications and result in a very longer pr processing timings.
- YOU must restore your status as soon as possible (very very important) there is a safe 90 days limit you can check details from cic website.
- the day you apply for restoration you will become with a legal status i.e implied status ( and you can apply/submit pr application with implied status).
- You MUST remain in a legal status all the the time while your pr application is in process (Inland or outland whichever)
- you cannot apply for a TRV from within canada (their is no such option available for you). you can only apply for restoration of status and then extension to stay in canada as a visitor.
