I am a foreign student in the USA and have recently graduated from University(May 2nd 2014). While studying in the US my PR card has expired(July 2012, issued in 2008). I was wondering what the chances were of being admitted in Canada if I entered via the US by private car.

Hi,

I was wondering what the chances of me getting a travel document were. I am 23 years old and graduated from university in the US in May 2014. While attending school my pr expired in 2012. I also ended up going to college in the US because I was unable to get into a program for undergrad in Canada. While in the US i maintained a high academic record. I have visited Canada 4 times. The first being when i landed as a 16 year old and removed by my mother. The other three times was when i was a full time student in the US(between 19-20). I only went for a few days to visit my sister who is a PR there. I know there is new rule with the depends from 22 to 19 and wanted to know if I still have a good chance of getting a PR travel document. I was unable to retain my PR due to these reasons. Is this a valid reason under humanitarian and compassionate groups. Please let me know! I am anxious to get this solved!!

You're a bit on the old side to use the "I was removed from Canada by my parents" excuse for H&C reasons to obtain your TD. This typically works better at 18 or 19 years old. The excuse that you were unable to be admitted to an undergrad program in Canada most likely won't hold water and will be regarded as a life choice you made by deciding to study in the US rather than Canada - and not H&C. Having said that, you can certainly give it a try.

The operational manuals for the visa officer still say that they should consider if you are returning first chance after reaching the age of 22. However, as of August 1st, the max. age of a dependent child for immigration purposes will be under 19 instead of under 22. Therefore, this may change as well.

All you can do is try it and sooner than later. Either apply for a travel document before August 1st or enter Canada from the US as soon as possible.

Congrats on getting your PR TD :)

You now need to return to Canada before it expires. Otherwise, you'd have to apply for a new one and immigration gets mighty irritated if you tell them you need one and then don't use it. A new one may not be so easy to get.
