Conditional Permanent Residence - New Rules as of Oct 2013

My husband and I were married August 2011 and submitted sponsorship December 2013, husband received PRV May 2014.
Do we fall within the new rules as of October 2012?

We were married 2 years and 4 months before application was submitted, application submitted after new rules went into effect.

Is this an either or situation or do we have to be married less than two years?

Conditional PR came into effect in Oct 2012, not 2013. As you were married for more than 2 years prior to submitting the app, your husband should not have conditional PR.

His COPR will state whether he does or not; it's called Condition 51.
