Hi All !

My Boyfriend (Canadian citizen) is sponsoring me (new zealand citizen) for permanent residency through common-law sponsorship.

Do we need to fill out the form 'IMM 5409 - Statutory Declaration of Common-Law Union' ? The instruction Guide 3900 (http://www.cic.gc.ca/english/information/applications/guides/3900ETOC.asp) says that we dont need to fill it out as my sponsor does not have a co-signer.

The call centre told me yesterday that I had to fill it out and send it.

I am seeking clarification and appreciate any help.

The instruction guide would have more credence than the call centre representative, IMHO, as they've been know to be WRONG before. ;)

The consensus here is that it is not required, unless specifically asked for by CIC as they are processing your application. There's no harm in sending it anyway, if it gives you added peace of mind.

Thought so myself. I wish things were more transparent on the website and seriously the CIC need to update the website and most of their forms.
