Hi All,

I am planning to apply for Canadian PR and have a confusion related to NOC codes. I have been working in Canada since Sep 2010 and have been issued 3 different Work permits with varying occupation codes. I have a closed WP under ICT (Intra Company Transferee).

1) WP1 valid from Sep 2010 - Feb 2011 title - Comp Analysts & Consultants (NOC Code 2171). My job role was that of a QA Analyst
2) WP2 valid until Aug 2012 - title - Software & Comp system evaluators (NOC Code 2283). My role was that of a Software Tester
3) WP3 valid until Jun 2014 - title Project Manager (NOC Code 0213). My Work permit extension was filed with the role as Software tester, however when I received my WP, the title on WP was Project Manager. The Immigration lawyers told me that it was a mistake by CIC.

My company doesn't provide Employment reference letter so I am planning on using the Letters provided by company to CIC for WP Extension. In this case, pls advise which NOC code should I use for filing the PR.

The WP extension supporting letters reflect the job duties and responsibilities reflecting Software tester however the title on latest WP says Project Manager.

Pls advise.

I applied with a written explanation that my employer refused to issue a reference letter along with other available documentation.
Waiting for AOR, I will update you if I succeed.

Just called CIC call centre. They told me that on my current WP the title is Project Manager with the code 2283000.

Does that mean that my NOC code is 2283 only and that the occupation/title on WP is just an aberration? The officer did not clarify whether that code denotes the NOC code.

No, I'm saying the opposite! If you are on a closed work permit, you should always use the NOC attached to your permit. Otherwise, CIC can (and have) claimed that your experience is unauthorized.

Spoke to CIC again on this. They clearly mentioned that the NOC code attached to my current Work permit is 2283000 which is Software testing technicians. However, the Occupation title stated is Project Manager.

So, what I am trying to say is that I would apply with NOC code 2283 and ignore the occupation enlisted on the WP. (as I believe the NOC code should be more imp than the occupation title on WP).

Do you agree?

Titles are deceiving, and not the primary basis of determining the NOC code. The most important component is your job duties, which from your reference letter should match the NOC code in your WP and Application.

Correct - but you need to be careful.

If you have a CLOSED WORK PERMIT it carries with it the "NOC TITLE". This is the NOC that is attached to your CLOSED WORK PERMIT. If you use a different NOC, CIC can say your work experience is unauthorized as it contravenes the terms of the work permit.

Only those who have an OPEN WORK PERMIT are in a position to "CHOOSE" an NOC they feel best matches there experience.

If you are on a closed work permit, you really need to use the NOC attached to your work permit. If it's 2283 - then that is the one you should use.

To put this into perspective for you:

My work permit states my official tittle with the company, it doesn't state my NOC but it makes reference to "Manufacturing managers" which when looked up is NOC 0911.

If the NOC attached to your permit is 2283 then chances are if you look at your work permit it will somewhere mention "Information systems testing technicians" or one of the associated titles for that NOC.
