Hi Everyone,

Just need some clarification.. I received my COPR about 2 months ago. I have my pgwp that was bridged during my application process. This work permit expires this month.. I'm not leaving the country till October, so I have to do my landing then. Will I have a problem to stay in the Canada? am I good to stay till I do my landing at anytime before my COPR expires? Please help!! Thanks in advance!!

Is there any way you can get to a border and flagpoll to activate your PR status? You're so close to the end of your process, and trying to mess around with work permits and implied status if the permit runs out is making things unnecessarily complicated at this stage. I would suggest finding the cheapest way to get to a border and then just go finalise things.

Hi Quink,

Is there anyway that I can stay? Because I do not have a US visa to do the flag pulling out of border? I'm stressed because I have three weeks before my work permit expires. I just want to know if I would still be implied status until I do a landing when I leave in October? Have you heard of any cases like me? I appreciate any help thank you

I don't think you need a US Visa to flagpoll, because you're not technically entering the US. It's sort of an immigration loophole / grey area. You go to the border, but when you speak to the US boarder guard you tell them you need to flagpoll to activate your Canadian PR. They give you what's called an "administrative refusal" which means you are withdrawing your request to enter the US, and they turn you around and send you back to Canada. The beauty of this though, is that since you're past the physical border you need to go back through Canada Border Services Agency, and on that side they treat it as if you actually did leave Canada. This allows you to "land" at a port of entry, and all you do then is show them the COPR, answer some questions, they make sure all your papers are in order, and then you're a permanent resident! No more problems with work permits anymore! :D

Here's a quick disclaimer though. Make sure to get a second opinion on all that. I'm 99% sure you're OK to flagpoll without a US Visa, but it'd be good to double check that. And you'd better be doubly certain to have all of your Canadian papers, or you could get stuck in no-mans land.
